Dependent visa for my son tier 1

Dependent visa for my son tier 1

hi all
i want to know that i want to apply my 15 old son visa from out side UK. i am currently on tier 1 visa. my wife has got a 10 years ban due to deception in her application (320B). can i apply for my sons visa as dependent of tier 1 visa holder. as the rule says that 320B does not apply to children.
can any one help me on this or any other alternative route which allows me to bring my son in UK.

You son can't qualify for this visa if your wife is not in the UK or applying at the same time.

(f) Both of the applicant's parents must either be lawfully present in the UK, or being granted entry clearance or leave to remain at the same time as the applicant or one parent must be lawfully present in the UK and the other is being granted entry clearance or leave to remain at the same time as the applicant, unless:

(i) The Relevant Points Based System Migrant is the applicant's sole surviving parent, or

(ii) The Relevant Points Based System Migrant parent has and has had sole responsibility for the applicant's upbringing, or

(iii) there are serious or compelling family or other considerations which would make it desirable not to refuse the application and suitable arrangements have been made in the UK for the applicant's care.

thanks for you reply. i consult a lawyer here in UK and he says that if i can prove that i am his sole responsible for his upbringing then he can qualify for the visa..... can you help me that what kind of documents do i need to prove this, and what are the chances to get the visa,,,,,
as lawyer is going to charge me a fees on further consultation

Yes, that would be with regard to (ii) in the text that I have previously posted. You don't have sole responsibility so stop wasting your time or money.
