ILR 10yr residency

Hi
I have applied for ILR based on 25/8/12 10 yr stay. My current visa will expire in April. I am also eligible to apply for ILR based on Tier 1 5yr visa. If my visa gets rejected after April can I still apply for ILR through second route provide I apply within 28 days of refusal? Has anyone tried this. Any suggestion would be helpful. I am also tempted to request for documents back and apply in new category.

First of all why do you think your ILR based on 10 years will get rejected? If you case was straightforward wont recommend requesting your docs back as it's been 6 months already and the result won't be that far away now.

If you decide to get your docs back you can make a fresh application for ILR under tier 1 option which means if you make postal application then again 6 months of exile or if PEO then you have to think of cost involvement. Also how sure are you about your ILR through tier 1?

Hi Thanks for the reply. I guess it is just a fear of unknown as it is taking long time and my dependent's visa will also expire on 15/4/13. HO suggested I could send their FLR M application if I don't get my passport. As far as I can think both 10yr route and tier 1 st forward in my case.
