PSW to Student Visa

Hi,

I need your advice om my case, please.

I came to UK to Study ACCA in 2006 July 3. Unfortunately I did not complete my AccA but did my BA In applied accounting and completed it on Feb 2012. I have a PSW Visa which will expire on 14 Aug 2014. I want to study MBA. Can I get a Visa for MBA in 2014 and will I be eligible to apply for a indefinite leave after i Complete my 2yr MBA.

any studies done on a PSW is not counted towards the 5 year rule, it is a possibility to apply for a Tier 4 after your PSW in 2014.

Thank you for your reply. But I don't intend to study while i am on PSW. I want to extend my visa as a student once my PSW expires. And then will my Period in UK from 2006 Jul 3 qualify me to get a indefinite leave.

Do I understand correctly from your post that from July 2006 - February 2012 you were studying at degree level whilst on student/tier 4 visas?

yes, I was on Student visa from July 2006 - Feb 2012, & them a PSW from Aug 2012 to Aug 2014

I started as an ACCA student, I could not pass more than 3 papers so in Sept 2010 i changed my course to BA in Applied Accounting

what level was the visa issued for when you were studying ACCA?

What do u mean by what level, please clarify, I was issued a normal student visa till 2009, and then around 2008/2009 i was issued a tier 4 student visa

To qualify for ILR, you need to stay in UK legally for 10 years (in your case, 2016) Therefore, you should look for something which can help you stay here for 3 years.

You have couple of options.

- Tier 4
You can study MBA, but you will only be given 2 years (not 3)

- Tier 1
You can either apply for £50,000 sponsor route or you can apply via Venture Capital's £50,000 route. However Venture Capital have less restrictions. You will get 3 years visa straight away

- Tier 2
If you can find company to sponsor you, then it's fine. But if their license is revoked, then you're screwed again

Woow...that's a very good explanation....but if i apply for a 2yr tier 4 student visa in May 2014. would that qualify for ILR

Can you please let me know about the venture capital please

sorry i wasnt quite clear.

as you may know you can only study a level 7 course for 5 years (unless it's a masters degree/PHD in public funded institution).

if the ACCA course you did was level 7, you may already have exceeded this limit, therefore cannot apply for a Tier 4 again.

you can check this on the CAS letter that was issued to you.

it should state the length of the course and the NQF level.

the 5 year limit is imposed on courses at NQF level 5 and above.

I booked for Part 2 6 papers, but passed only 3 papers

in that case it's counted towards the 5 year limit and you have exceeded the limit. if you wish to apply for a tier 4 again, it must be a masters/PHD programme in a gov funded institution.

it looks like you only have other tiers as your options.
