Let me first appreciate this board for its efforts to help and advices.
I need some advice on the ILR w.r.t new rule from 12th Dec 2012 for long gaps.
I got HSMP approval in country in Feb 2006 and stamped in May 2006, come under Judicial Review and due for PR in 4 years in May 2010 but was in India due to minor medical reasons for 14 months from Jul 2008 - Oct 2010) at a stretch. Visa due to expire in May 2011 and went for 2nd extension instead of ILR as the clock was zero.
Now the ILR is due in May 2014 but want to take a risk under the new rule of Dec 2012 about the long gaps.
Question: I want to take this risk of applying for ILR this month but need advices to do paper work accordingly and If I am eligible straight forward then want to include 3 dependents, otherwise just my self ?
My history:
Feb 2002 - EC to UK on Student
Feb 2002 - May 2006 Student Visa ( with some gaps less than 90 days )
Feb 2006 - HSMP approval 2+3 Yr category; Stamped - May 2006
May 2006 - May 2008 (HSMP)
May 2008 - May 2011 (Tier 1 General)
May 2011 - May 2014 (Tier 1 2nd extension)
Gaps:
29 Jun 2006 - 14 Sep 2006 (76 Days) - Dad's Operation
02 Aug 2007 - 30 Oct 2007 (88 Days) On Job - Own Limited Company - IT Consultant
07 Aug 2008 - 23 Oct 2008 (76 days) Marriage
27 Nov 2008 - 24 Dec 2008 (26 Days) Holiday Tour
30 Jul 2009 - 14 Oct 2010 ( 1yr. 44 Days)
I have own limited company and take Unix Contracts and can cover gaps as business development trips.
