If Hungarian residence permit denied... what next?

Post by Hungarianliving » Tue Mar 05, 2013 1:10 pm

Hello, I have applied for a hungarian residence permit. This is an EU permit in a schengen country.

If I am denied, I need a backup plan. For various reasons, I have to remain in Europe. So if anyone knows the answers to the following please let me know.

1: If denied, can I go to the UK? or am I excluded from all schengen and EU countries? (UK is eu, but not schengen)

2. Could I apply for residence in another EU country after this?

3. If all else fails, when will I be able to re-enter the EU, and/or the Schengen Zone? 3 months? or longer?

You provide very little information about your situation. So it is hard to tell.

Any real replies?

My situation is not complicated, in fact this is more of a basic general question of what happens when an EU permit is denied, not for any bad reasons, just denied...

are you allowed to go to the UK or is this excluded?

and are you allowed to return? and if so when?

If there are no answers to such general questions I understand, but I imagine there is a basic answer here.

You have applied for a permit. On what basis?

The application is not yet decided. I suggest you wait until it is decided and don't worry about what might happen.

If the application was not successful, it would not automatically bar another application in another country if the requirements of that country were met.

If you wish to elaborate on your situation, you might get a more substantive response.

Best of luck.

Your situation is very different if you are married to an Irish person and you were refused for not paying the correct fee for the visa, than if you are Rwandan with no ties to Hungary who was refused because of an extensive past of war crimes.

It depends!

If you do not want to explain your situation, then a lawyer might be better placed to help.
