When to apply for ILR for wife

Post by angelloveguy » Thu Mar 07, 2013 7:49 pm

My wife came here in UK on 15/05/2009 on Tier1(Post study visa Dependant) and than she became my Tier1 (General) Dependant on 04/05/2011. She later on got FLR(M) visa on 15/12/2012 on the basis of my ILR.

Can anyone help me and let me know when is she eligible for ILR?

Regards

When did you apply for ILR? If it was any later than May 2011, I wonder why she did not apply jointly with you. If you were granted under longer residence she should have switched to FLR and then immediately applied for ILR.

Hi,

Can you tell when your tier 1 general expired.

Reason is that you mentioned you go ILR on Feb 2012 and your wife got FLR on 12-dec-2012.

So i assume your wife status from Feb to Dec 2012 was in Tier 1 dependant whereas you were already ILR during that time.

Is it allowed that the main applicant being ILR and spouse being Tier 1 dependant.

Please advise as I am in same situation.

Regards

I got my ILR in Feb 2012 and than I applied for her ILR on SET(M) I was told by UKBA via email that she is eligible for ILR but when I applied for her ILR it was refused after six months and I was told to send FLR(M) form for her. So I applied again for her FLR(M) in August which was granted in December 2012.

Now via this forus I have been told that she doesnt need to complete two years on FLR as she already completed her two years as my dependant.

Hi All,

Even though the moderators in the forum has mentioned that it is not an issue, I am still concerned as many people are giving mixed responses.

As I will be applying myself for ILR in MAy, my wife will apply only on August since she is travelling to india on April along with kid.

Is this ok or she will face any issue with immigration, Since my kid is born here in UK, i am planning to apply for her citizenship.

I am bit worried whether I need to make my spouse and kid apply for FLR if they are refused entry and stay another 5 years for PR.

I even had option to apply for wife and myself , but again the kid will be in Tier 1 dependant only.

Please note that tier1 is valid till march 2014, so i hope their visas will not be refused when they reenter uk.

They should be okay.

My wife was Tier 1 General Dependant for one year when I got my ILR and then she got FLR(M) and now she has completed one year on FLR(M)So it's now two years including Tier 1 genreal Dependant.

I don't know will she get ILR now on that basis?
