Employer Pay Mistake

Hullo,

My wife is going to be applying for a visa in a few months, and I'm currently earning above the magic 18.6 threshold due to a temporary promotion.

However, my employer made a mistake and didn't pay me the uplift which takes me from under the threshold (around 17k) to above.

I'm a bit worried, as they were apologetic and did back pay me. I've also got the chain of emails where they admit their mistake. I'm wondering though if this would be enough in the eyes of the UKBA.

I really don't want to apply a month later as we've already been separated for a while and wonder whether the chain of emails, the February payslip with extra pay and possibly a letter of explanation would do the trick? I work for a devolved part of the government, so it's not like the employer is going to be untrustworthy or anything.

Any advice gratefully accepted.

In theory, with all the explanations and the extra pay slip, it should be ok.

In practice you're risking that the ECO takes the time to read it, understand it, and apply common sense.

In the event - you might find yourself waiting longer than just an additional month if you get a rejection and have to go through the appeal/reconsideration process.

Personally - I'd wait the extra month.

One final thing to think about - don't forget that in 30 months time post application you're going to have to show the income levels again ... a temporary promotion is well and good - but you need to consider what happens then ...
