SOC Code Query

Dear Guru's/Sage's,

I have an urgent query regarding my SoC. I am currently on a Tier 2 ICT visa and like any Indian IT company my company is also not telling me my SoC code. I had a look at the current SoC code list and got really confused and need some urgent help as I am trying to get appointment for the next week. Some details around my Query first:

1/ As per my CoS:
My Salary is: 43342 GBP
My Role is: Business Development Manager

2/ As per the UKBA SoC list, there is no such role as Business Development Manager in "Section J: Information and communication", this section usually covers the IT jobs.

3/ There is though a job titled Business development Manager in "Section N - Administrative and support service activities" with SoC code 1132 with a minimum rate of 15.88 per hour. Now assuming a 40 hour work week this convertes to 33000 GBP.

My Query is: Which SoC Code should I go with in my ILR application. Should I:

A. Pick up the soc code for BDM (role as per my CoS), in this case my salary mentioned in CoS will be much higher that the limit for this code, will this cause an issue due to the salary or due to the fact that this code lies outside the section covering the IT jobs.

B. Or should I used my salary mentioned in my CoS and then pick up a matching SoC Code from the list in "Section J: Information and communication"

Please help.

How about SOC Code 1132. Does the list of duties same as your present job.

The problem here is COS should have a code. How is that with your list of Duties? Then you should choose that one. There shouldn;t be a big difference in Salaries? Employer will also will try to reduce and UKBA also must accept.

One more question n this topic.

The salary for soc 1132 is 15.88 per our but in my employer letter my annual salary is mentioned. Also there is no clear cut statement that my salary is above he soc code although sple calculation proves that. Well these two things cause an issue I.e.

A. Soc salary stated in hours in ukba doc and annual salary in my employer letter
B. no specific statement n employer letter that my salary is above the salary for this soc code.

A. Look at Sticky;s Template for a typical Employer's letter. It should be Annual Salary mentioned.

B. Your Employer's letter should mention whether your salary is equivalent 0r above the SOC Code salary.

Are you planning to go for a PEO appointment??. If you want advise post the list of documents you are having ,I will check it out or some one will give a better advise than me.

Also just give a draft of your Employer's letter too. If any changes to be made could advise you. No name of the Company or your name in the post.
