Naturalization and Warning on a petite mistake

hello everyone,
i have been following this web-site for my ILR and citizenship, but now i am needing an urgent advice on my issue. myself, mywife and daughter are going to apply for citizen late this year but last year i got a warning from Procurator fiscal- Scotland (Crown services- England) and said this warning will stay on my enhanced disclosure for two years. i want to know if UKBA do enhanced disclosure for every applicant or they do a basic disclosure. because it is a warning so do i need to mention it anywhere on the form?

What was the offence and was this a fine? If it was a Scottish Fiscal fine then it will not affect your application.

i accepted warning from fiscal rather than going for court. there was no fine. but warning will stay on enhanced disclosure for two years.

My understanding is that the procurator fiscal is the public prosecutor? So I imagine that a warning is similar to a warning in the UK as you accepted it that would indicate you accepted guilt similar to that of a police caution. If this is the case then the warning may be treated as a non custodial sentence and prevent a naturalisation application for 3 years. However, if it was a warning which was just given and you did not have to accept it and it was not issued by the court I would imagine it would not fall into the scope of a non custodial sentence. What was the offence?

offence was shoplifting it was for an amount of £3. i don't have any other history not even a parking ticket on me. would this still prevent me from applying?

I am not sure about Scottish law but if the warning was akin to a Police Caution it would likely fall within the scope of a non custodial conviction and prevent an application for 3 years. If it was considered more like a Fiscal Fine then it would not affect your application. Contact your local NCS and ask them to ring the UKBA caseworker (they can do this) to see if it would have any affect.

Thanks mate, but i still would like to know whether UKBA do a enhanced disclosure for every applicant or not? what if i apply for citizen ship and they refuse it on this group, will i be able to re-apply it after 3 years, will it affect my ILR status? if it is gamble of £800 than i am ready to take.

The ukba check information held on the PNC it is not an enhanced disclosure per se as it is not undertaken with the disclosure and barring service. It would not affect your ILR unless you failed to mention a material fact at the time of your ILR.
