That's true. You should not be penalized, if Unknowingly claiming the said discount. Though it would be rather unfair if someone applying for ILR in the near future were to be penalised because he claimed a single persons discount in the past (when it was allowed). If the single persons discount is deemed to be included in the "(HC1038) new definition of council tax reduction" (even though the current statement appears to indicate that it is not), then it would be reasonable to expect the applicant to stop claiming the discount from the date HC1038 is implemented and not be penalised for claiming the discount in the past.
