ILR Success Croydon - 5th April 2013

Hi

I had my ILR and my wife's Tier 1 extension approved in Croydon yesterday.The advice available on this forum has been very useful in preparing my documentation. Hence I am describing my case so it can help anyone whose circumstances might be similar to mine

I was on HSMP for two years and Tier 1 for 3 years with Tier 1 expiring on 29th Apr 2008. My HSMP Visa is valid from 29 Apr 2008 but I entered UK on 19th July 2008. The delay is less than 90 days (81 days) so that period could NOT be treated as an absence.

I have been in continuous permanent employment from Nov 2008 till Oct 2012. From Oct 2012 to Till date I have been contracting (through limited company)

I have submitted the following documents

1. Life In The UK Pass certificate
2. Personal Bank Statements for 12 months (I have chosen the period Mar 2012 - Feb 2013)
3. P60's for 4 years (2009, 2010, 2011,2012)
4. Payslips for 12 months
5. Dividend vouchers for 5 months
6. Business Bank Statements
7. Certificate of Incorporation (limited company)
8. VAT registration certificate (limited company)
9. Letter from my accountant about salary and dividend (net and gross)
10. Letter from my previous employer confirming my employment there
11. Letter from my previous employer confirming my business related absences (I think this was not needed but I had included in the file anyway)
12. Invoices raised to show my limited company activity (These again I am not sure is needed or not but included anyway)

Thats about the documentation which went with my application.

I knew mine was a straightforward application but I had only one worry. This is to do with National Insurance. With Permanent employment this would have been deducted by the employer. But I have been drawing combination of salary and dividend and I am drawing low wages so I dont pay any NI. However I was confused when the supporting documentation mentioned that if no NI is paid proof of small savings exception certificate is needed. I did some research online and also spoke to my accountant and this is only needed for Sole Trader and not for someone operating through Limited company. Accordingly I did not include anything of that sort in my file.

For my wife she was not yet eligible to apply for ILR as she has not completed 2 years in UK. So she needs extension of Tier 1 dependant. For her I have submitted 3 months bank statement to show the funds, marriage certificate, council tax bill

My appointment was at 12:40 and the whole process from time of arrival took 4 hours. And I had my appointment booked through Solicitor (As I could not get my slot booked on time).

Hi rana,

It looks like my case is similar, I will be eligible this May and my wife not. So my question is how did you book the appointments to youself and your wife. Is it same appointment or different? And what forms you used?

Hi Venkat

Yes I have booked two appointments. As my wife is still not eligible for ILR my solicitor told that two separate appointments need to be taken. My appointment was at 12 40 and my wife appointment was at 14 00. However after we went to Home Office they considered our case at the same time. This may be dependant on the case worker

For my wife I have used PBS dependant form.

Hi Venkat mine is same case like yours. I am applying for ILR in May. My wife came to UK a year ago. Does she has to pass Level 1 or higher level of English language for her extension. Which form does she has to use for extension. Your help would be greatly appreciated. Waiting for your response.
