I'm desperately in need of some advice on what would be the worse outcome that could happen in my case.
Basically, my passport is stuck with the UKBA having been sent to support my parents EEA2 applications, and despite it was requested back few weeks ago .. it's not arrived yet.
I'm non-EU and has lived with an "exercising EU rights" wife in the UK since 2008. Due to unforeseen family reasons we ought to be in Spain coming Monday (in 2 days time). The flight tickets have already been booked. Obviously, my wife would have no hassle getting into her own country with her ID, and having a Spanish residence card myself "tarjeta de residencia comuntario" I think I would also be able to convince the Spanish immigration officers to let me in country with no passport.
However, my question is: what will happen when I fly back to the UK next week? Will they show a realistic understanding of my situation given I provide evidence of my UK life (rental contract, utility bills, bank statements) and the CoA of parents EEA2; to let me enter the UK again with no passport? (got a copy of both the passport and my RC, though). Also, my EU wife will be travelling with me as well as our marriage certificate.
I'm very worried what to expect in the worse-case scenario if I'm not allowed to enter the country again. If travelling to Spain was not a matter of urgency I would've waited till I got my passport back from UKBA before heading off. But unexpectedly I've found myself in this situation and not sure about the consequences of my upcoming travel.
