eea3 eligibility

Post by Garry00 » Mon Apr 15, 2013 12:47 pm

Hello,

I am a little confused here so could anyone kindly advice me on my case.

-EEA citizen from Latvia entered the UK 10/09/07 - as a student and lived five years as a student

Student

Sept 2007-June 2011
Sept 2011-Oct 2012

Employment

19/11/2008 - 31/05/2011
01/04/2010 - 30/04/2010
01/07/2011 - 31/10/2011
01/06/2012 - 31/08/2012

WRS

Received my WRS registration card dated on the 17/09/2009. I applied it while i was studying in the university and to undertake part time employment.

I never applied for EEA1 certificate.

CSI

03/07/2007 - 03/07/2008
31/08/2009 - 31/08/2012
22/08/2012 - 22/08/2015

Additional Information

After i finished my education in Oct 2012 I stayed home due to my pregnancy. In November 2012 I registered as a Jobseeker until today so I am not sure which category I would fall under after my education finished.

I have gap of almost a year in CSI from 04/07/2008 - 30/08/2009.

I am not sure when CSI requirement was introduced? Will i be able to get away with this gap as it was between 2008 and 2009 and CSI requirement was enforced later on?

I am also married to a pakistani man who has received his british citizenship last week.

Summary

Can some one please advice me if i can apply for EEA3 to get british citizenship as I have lived here for more than 5 years?

If EEA3 is not for me, which possible application can i make?

I would be very grateful for you advice and suggestions.

Best Regards

Thanks for your reply! I have read that chapter a few times before but still cant figure out my case.

Now I am reading the "Annex B – Comprehensive sickness insurance – Transitional arrangements for students" section. Where it states that:
1. From 20th June 2011 all EEA national students and self-sufficient
persons (including A2 nationals) who are applying for documentary
evidence of their right to reside in the UK, must provide evidence that
they have comprehensive sickness insurance in the UK.

2. Transitional arrangements are being introduced, so that an application
for permanent residence as a student will not be refused solely on the
grounds that there is no evidence of comprehensive sickness insurance
on the date of decision where:

UKBA issued a registration certificate to the applicant on the basis of
their residence in the UK as a student before 20th June 2011.
Can someone clarify which registration certificate it is speaking about? I have been give WRS certificate. Is it reffering it to that one?

Also When i applied for it, I was student but i cant remember and if i checked the student box or the worker box when I applied for it.

Registration Certificate means EEA national's confirmation of residence right through EEA1 which is entirely optional. And WRS certificate refers to worker registrtion scheme that was abolished in May 2011 under which an A8 national worker need to register and have to complete 12 months.

Since I dont have EEA1, does that disqualify me getting PR under the above explained circumstances?
