WP + Tier 2 (ICT) ILR Success with Dependent @ Croydon

Hello Everyone, Firstly thank you everyone who has been helpful in the forum. This has helped immensely with my ILR application. For the benefit of people (Especially WP + Tier 2 (ICT)) here is my experience.

Appointment booked at Croydon. Since I have booked appointment a day before I called UKBA to pay for deposit on the day of appointment. I was told if appointment is within 5 days of applicant calling for deposit then they won’t take the deposit money as they are unable to inform PEO about the advance deposit as there system is not upgraded yet. In this case they will make an entry in the system regarding my call and I have to pay complete amount inside PEO with my application. I was also told by my solicitor that UKBA won’t cancel the appointments according to the new rules even if deposit is not paid if the appointment is within 42 days from 5th April as those will be re-released appointments booked under old rules.

On the day of appointment I was accompanied by the solicitor. In brief process is to first collect a token for application, then wait for token to be called for making an application payment. Then wait for token to be called for Biometric Registration. Then wait for token to be called for Biometrics. At the time of Biometric file with the application and all the documents to be submitted, which will internally move to case worker.

Time taken from collecting the token till biometric was around 1 hour. As I was accompanied by a solicitor everything was quick as he knew the process. There was a system in place in Croydon PEO where file will be submitted during biometric and on screen status of the application will come. Basically screen will show following status, Awaiting Biometric, Awaiting Case Worker Consideration, Under Consideration and Ready for Collection. After biometric it took about 2.5 hours for my file to come under consideration status. And another 1.5 hours for ready for collection status. In between few people were being called I guess for clarification with case worker if there is something missing or incomplete in the file. Number being called in the middle were very few and most of the token were going to ready for collection state.

As I was a WP + Tier 2 holder there were few complication with my case. So I will write some details for others benefit. Employer was not helpful and employer letter did not specifically mentioned that I am being paid according to SOC code. But letter did mentioned SOC code, gross annually salary and I am required for the job. I had a total of around 120 days of absence in three breaks out of UK. Two were paid UK leaves and one absence of 80 days I was not paid in the UK. But I didn’t provided any proof or letter of absence as my solicitor was adamant that nothing will be asked. He even didn’t included personal letter, medical letters etc for the absences. This was my biggest worry and could be the worry of other Tier 2 ICT aspirants. I did consulted many people with personal experience of ILR and solicitors and I was advised that if absence is less (Old 90/180 days still being considered) then case worker won’t ask for any letters or will be considerate. Though according to the rules it is required and so I was advised on the forum.

Received BRP after two days but one BRP missing a character in Place of Birth so will have to follow-up with BRPError.

many many congratulations to you...your case is just like mine...my employer is not at all helpful...can you please tell me of the employer letter was for the purpose of ILR or any other specific purpose was written??? what did you filled in section 6 of SET(o) form where it asks for evidence submitted to support annual paid leaves???? did you left it blank or did you choose any option????????? please guide...

Purpose in the letter was written as family visa. I have heard (though unconfirmed) that people also got ILR approved with the letter having full details but purpose mentioned as home loan, dependent visa etc. Least requirement is to have SOC code, Job Title, Salary and a line saying I am required for the job otherwise it could jeopardise the application.

For section 6.2 I wrote "please see enclosed" and attached a sheet with day-in and day-out details by mentioning passport stamp pages. This was similar to one of the spread sheet in sticky. But I removed paid-unpaid details. Section 6.3 I left it blank. Though if you want I have heard my friends enclosing a personal letter for the leave details. From all the people I spoke to, case worker will not insist on reason/proof of absence if very few days out. And you can provide a personal letter, payslip during that period, any other evidence if actual letter of absence from employer is not available. But this discretion if only when there are few days out of UK.

Congratulation!!! Did the employer letter have SOC code 2010 or 2000 ?

In my case SOC 2000 and 2010 were same. But yes this is a unanswered question. But I would say preferably if 2010 is mentioned that will work better or even if it is 2000 then it should do as you may got cos with that code. There are also transitional arrangements till 26th April so I guess they will be considerate.

Congratulations. Your documents seem alright to me. Is there any special reason you employed a Solicitor. I know a Solicitor who charges by the hour. CW only speaks to the Solicitor not to the Applicant,Is that right?

Kevin, Thanks to you for answering some of my queries. There was no special reason for a solicitor. As I was a Tier 2 ICT and my visa was expiring this month itself so i didn't wanted to take any chances. As we all know the rules and requirements but I just went with a solicitor if it at all makes any difference will be beneficial for my case.

With solicitor he acts on your behalf as representative and people in peo kind of know them. Yes they can answer on your behalf or answer/argue if there is any complexity. You can also take any question from case worker even if you have a representative. In my case process changed in Croydon peo and there was no case worker appointment. So you give the file during biometric and wait for results to come out on the screen. Caseworker may call if there is any problem with the documents submitted.
