EEA1 & EEA2 Claiming Benefits

I was just curious about the following situation.


EEA national married a Non EEA national & get the both EEA1 & EEA2.

Then the EEA1 looses the job so can they claim benefits. They do not have a Baby. They are living in a shared property renting. They want to have their own 2 bedroom house before the baby can come. They think of claiming benefits.

If yes which of the following can they claim.

1. Housing.
2. Job Seekers
3. Low income support.


They also do not want the EEA2 national to not qualify for ILR. Indefinite Leave to remain after the end of the 5 years wait.

Please advice what benefits could they claim without effecting the ILR.

If EEA national does not work then what else mode of treaty rights he/she will excercise? Perhaps self sufficient. Isn't it?

If EEA national lhas lot job for a short period/few months, treaty rights is still exercised as worker if he/she registers as a jobseeker. Therefore, can claim jobseekers allowance. Not sure about the housing and income support.

@OP.
in the uk benefits are means tested on a couple as a whole.
if the partner is working their income is taken into account.

you can always register for job seekers, (and must if using treaty rights) but your payment may infact be nil.

housing benefit etc is the same.

there is a rule i saw somewhere that job seekers / etc can only be claimed for six months as a job seeker. at this point you become an unneccessary burden on public funds and must leave... (i will try and find the DWP document)

whilst working, you can claim any benefits that a british person can.

note until the baby is born, you are only entitled to a one bedroom property... two bedroom housing benefit is not payable until the child is born.

the rates payable its best to get in touch with your local council - rates for housing benefit vary.

once the baby is born, then the ctc/wtc/cb/etc is all the same whilst your elegible and meet the HRT (as in are legally resident within the UK)

i hope we dont have to claim benefits any ways. Just needed to know we have something covered if the days get tough.
