ILR dependent visa for ILR eligible dependent

ILR dependent visa for ILR eligible dependent

Hi. Have a unique situation..I obtained my ILR this month. My wife, currently on Tier 2 Dependent visa, is also eligible for ILR as she has already completed 2 years in UK. However, she's in India presently and may not able to travel before her current visa expires early May.

If she couldn't travel to UK before the visa expires, would I have to file ILR dependent visa for her from India or can she travel upto 28 days even post visa expiry? Can I get her Tier 2 dependent visa extended from India? If not and had to file ILR dependent, will she then lose the eligibility for ILR and have to wait for 5 yrs before ILR or Citizenship?

and also please note , Spouse visa from India now take around 3 months

Set O or Set F for dependents' ILR

Thanks Vinny and ilrdep. My wife managed to travel to UK along with our 2 month old baby. They both currently hold Tier 2 dependent visa until 12 May 2013. I need to apply for their ILR (I already possess ILR).

Since my wife already completed 2 years, I presume she'd apply on Set O form?

Can she include our baby as a dependent on her application? Or will we have to apply separately for the baby on Set F form? If the later, can baby get ILR before both parents attain ILR (given her mother's ilr application will also be underway then)?

I provided a co. letter with SOC etc. for my ILR application. Would I have to attach the same again for my dependents visa? I hope not! What details to fill under finance section of form Set O on salary etc. when my wife is not working and I will be supporting them?

Need some help urgently!
