Have recently arrived from Europe with non EEA family having exersized treaty rights as a worker took 2 hours at port to achieve embarcation and a few calls to UK immigration ten minute on arrival just wanted to see European rc for me and the family plus marriage certificate and a job offer nothing else.Thanks for the help earlier in the year guys they got a 6 month stamp each

I'm a brit returning on the singh route and I've just seen and printed the "eind" update the job center has indicated they want to do a "habitual residence" interview although I will claim exemption under the EEA worker rules however what is the effect of the eind ecj on me as a Brit with reference to any periods of inactivity in the next 5years in particular on CSI as I am not required to be active as an EEA national would for the family to be able to apply for PR ?

Does this mean we are exempted this rule?

I did read this jambo however in q5 there is no reference to the British national "not" being required to be active ie working or job seeking to remain qualified as per eind so would this have the effect of not requiring CSI as the families right to reside is not based on the same criteria as an EEA national?

Once you are back in the UK, there are no specific requirements. Under the Surinder Singh route, only the activities in the other member state matter. You are not required to work in the UK in order for the family member to reside in the UK.

Absolutely but in that case will I be treated as Brit and not as an EEA self suficiant in specific regarding periods of not working/not claiming and thus not need to show CSI cover for the family for those periods for example if we were away out of. The UK for say 4 months. In my understanding of EEA national when the 5years are up and my family apply for citizenship would csi be relevant in this case?

You would be a qualified person by your activities in another member state. What you do in the UK is irrelevant so CSI is not required.

In any case, even for "standard" EEA nationals, if you are away from the UK, CSI is not required for that period.

Thanks. Jambo I take that to mean I'm treated now the same as any other Brit who had remained in the UK except the family is here as if I were an EEA national but that no matter what I do I remain qualified by nature of my activities in Europe good news

Correct. All that is needed for PR is for your family members to live in the UK for 5 years. Make sure you keep records of your work in the other member state as your family members will need the evidence to support PR Confirmation application in 5 years time.
