Processes after allowing appeal

Post by sonyasking » Sat May 18, 2013 8:14 am

Hi

Can anybody please help me with the visa processing steps after appeal is allowed for settlement? And if possible, the contact number of the people/organisation that involve in this process? I need to know the exact status of my case.

How long does it take to complete my visa process?

I contacted UKBA PEO, Tribunal etc., but failed to get the concrete answer from them. I asked the relevant PoU too, but each time I phone them, I get the different persons over the phone, and they gave different contrasting information - how can it be?

So any help on the proper steps and the contacts for the relevant people would be appreciated.

Thanks

Sony

Your appeal will normally be implemented within 3 months from the date of the judges determination.

They will be in no hurry to implement your appeal. The team that refused your application is normally tasked with implementing your appeal.Write to them or phone them reminding them your appeal was successful.Don't bother phoning the 0870 number.

After 3 months if you have not heard from them contact your mp and ask him or her to help you.

Many thanks for your response.

I would like to make sure I have got the settlement, because the tribunal decision is a bit confusing.

So how can I be assured that I will get the settlement so that need not to reapply for extension for limited leave? And for reapply I think there is time limitation (28 days), so it is important to be assured what UKBA is going to do on my case (yes appeal allowed so may be it is straightforward to understand I will get ILR - but the appeal is allowed beyond the ground we were claiming so that it made me confused)

I am afraid i am finding the above post slightly difficult to understand. If the judge ruled you are entitled to ILR you will get ILR also known as settlement.

It will be of great help if you could post the judges determination here withholding your personal details.

Did you have a lawyer help you with your appeal? What are they saying after reading the judges determination?

If you had gone through appeal process , I guess you were represented by a lawyer who probably would let you know the interpretation of the appeal determination .The other option is to let the forum knows the full contents of appeal determination but you are at liberty to exclude your personal details.
Conclusively however, if you were not represented by a lawyer, which is doubtful anyway, and the appeal determination is an open ended (that is appeal allowed in your favour but judge left the decision to grant your settlement or extend your Visa to UKBA) , then you need to be extremely careful not to compound issues yourself by bombading them with calls.

The best option is let this forum knows the details of your appeal case and the full determination of its outcome,am sure there are people (seniors, gurus and even moderators) who will respond and advise you accordingly on what you need to do .

BEST OF LUCK
