Applying for Tier 5 Visa (YMS) with binding over order..

Post by hotdog13567 » Thu May 23, 2013 4:22 am

Hello! My name is Oscar. I am from Hong Kong and I am 19 years old.
Now Im planning to apply for the working holiday visa (youth mobility scheme) to go to London and work there for two years
but last year I did something stupid (theft and being nude in public), However, I was not convicted and I was given a chance and I had to keep the peace for 1 year (binding over), and the deadline is 26/09/2013. So I would like to apply for the visa in November and by that time I will turn 20 (my birthday is 16th Nov).
I would like to know if I need to disclose it on the application form cos I was not convicted and even if I were, it would have got spent (1 year is over), so there is no need to disclose it?
But at the same time I'm worried that they will think it is dishonesty and then I get banned.. should I disclose it on the app form? Please help me!

If the form says "arrested or convicted" you should tick yes and explain. These things are often not deemed as spent under UK law until 5 years passes. If the form just says "convicted" then you can tick no.
