18600 financial requirement and appeal?

Post by Brewster38 » Tue May 28, 2013 8:32 pm

Has anyone not reaching the 18600 financial requirement applying for fiance visa won on appeal?

Or would there be no point in applying as i though the 18600 was a must?

I heard from a mate about a couple winning on appeal even though they didnt meet the 18600 but can't find anything anywhere about it.

You must meet the financial requirement. Perhaps they were granted leave to remain under the family life provisions?

My mate is in the USA and wife the sponser is in the UK wanting him to join her and child.

He seems to think that even though wife does not meet 18600 financial requirement he can apply anyway and when refused will win on appeal?

Personally im sticking with working my arse off for the year and trying to meet the financial requirement!

The spouse of people who are disable or on disability allowance, are usually exempted from the 18600 requirement.

In certain circumstances where exception 1 applies, the 18600 requirement could be waived.

Someone could also be exempted, if it is found that applying the 18600 requirement, will result in a disproportionate interferance with the right to family life between the sponsor and the applicant.
