Hi Guys,
Need help
І applied for naturalization on 22 April 2013 via solicitor. І received IRL on 9 July 2010 type permit: settlement. І received my ILR on ground out of immigration rules. I’m not apply after one year on ILR, because І went in NCS Hounslow in September 2012 show them my passport and ILR and they said І have to meet criteria 5 years residential period be legal in UK.
І talk to solicitor who was help me with ILR application and he said, they don’t know this situation and if І like he can fill my Naturalization from and send it to Home Office of course not for free. Solicitor said he get some instruction from HO how to fill form for my particular case and he already was apply for his clients with same criteria and they application was successful.
І agreed with him, provide all documents which is he asked and we fill form and send the form on 23-24 April 2013, I’m not sure. І checked my credit card statement money was taken from account 15 May 2013 but till now І haven’t got any acknowledgment letter or other correspondence from HO, UKBA or solicitor.
Has anybody already had this situation and what can I do, I am very worried?
Please give me advice.

Its caseworker job to make whatever enquiries he wants to make. If he wants any information from your husband, then let him get this information. If he can't contact your husband by phone, then let him write to your husband. Why do you worry and take headache of a caseworker?

If your application is correct, then you do not need to worry about internal UKBA matters. Its their headache, let them deal with it.
Friends, thanks for all your support. I have received my naturalization approval letter through this morning. Seems the call from case worker didnt deter my application time lines. I have included specific time lines with my application in the naturalization processing timelines only page.

Hi, I need some idea. I have seen somewhere very detailed and helpful FAQs on naturalisation.
It says there that HO check for inland revenue, but on the other hand it's not required to be employed at the time of application.

Also, it says that HO checks the council tax, but anyone can be on rented or even shared accommodation where he is not liable of council tax. Typical scenario would be in the areas like east London or southal where rents are inclusive for small flats which are converted and I have seen many properties where LL has not paid the tax uptodate though its in his name. In that case would applicant have problem in his application?

Lastly, I have a question that I am self employed and director of my company. I simply send the cheque for whatever amount I get from my accountant but I received call from him saying that hmrc has not received any payment this year. Which I am. Going to send him my bank statement that I have paied. But I am worried as I have submitted my application on 24 may 2013 for naturalisation and if HO had contacted hmrc then they would have negative response from them. What should I do in this case.

Not really an immigration matter. Sort it out with hmrc. It does not sound right that you pay by cheque to hmrc and payment clears to hmrc and then hmrc says they havent got it.

I am sure you are not telling the truth. If tax has not been paid, hmrc sends you a proper letter, they don't just ring you and ask for money. If you don't pay after getting their letter, they regularly keep sending reminders. It seems you have defaulted on your tax payments and now just trying to find a way to get through your naturalisation.

If I had to hide, then why would I ask here.....
As I mentioned, it's my accountant who deals with all tax matters. I haven't received any letter from hmrc at all. My accountant called me and asked this. He also mentioned that they have got these letters for many other clients. It was probably NI contribution. He sends me a bank giro with hmrc details and account number printed on it and asks me in the letter specifically to send a company cheque.
Any chance for comments on other part of question please.

Yes, you do not need to be employed, but on the other hand if you are actually employed then you are supposed to pay tax and NI and not work just cash in hand. Just an example to give you the idea what its about.

Since you run a limited company, you are expected to pay tax and ni due on the company. It seems you are not very familiar with tax and accounting matters and just blindly follow the accountant. Good idea will be to familiarize yourself with the basics of how it all works.

Same goes with council tax. You must pay council tax if you are liable to pay council tax. If you live with your uncle who pays his council tax, then you are not liable to pay for council tax.

If your uncle has a car, then its your uncle who is liable to insure the car, not you.

Same goes with absolutely everything in life.

You are not required to pay for something that you are not liable for.

With due respect, I didn't like the way you replied previous message, which was a bit harsh.

Well, you are right, I am not good in tax matters. I am a chartered surveyor and extremely busy in my work, I pay reasonable amount to my accountant who deals with all matters and I am in the process of registering for vat, and my accountant is dealing with this. I could have done all these myself, but I think it's more value for money if I concentrate on my own work, therefore, I simply forward my bank statements to my accountant and just forward the cheque every month on his instructions.

Now, my question is, in this situation, if HO contact the hmrc, would it be negative impact, though I have paid but for some reason if hmrc has not received then they can say to HO that they haven't received. Or is it must that HO check hmrc or should I just wait?

I would say, take the common sense approach. That would mean that make sure you have not defaulted (gone past the deadline) of paying any tax or NI.

Hi! Guys

I'm new to this forum; I've joined it because it seems quite useful and based on people's experiences and data

This is my question: I'm a EU citizen and have been living and working full time in the UK for 10 years, so I'm thinking of applying for naturalisation; I've never had any conviction, fine, insolvency, I pay income tax and NI (through my employer) etc.... and I meet all the criteria, my only concern is that 3 years ago I was sharing a flat with the Landlord and the Council Tax wasn't in my name, I don't have the contract and couldn't get a hold of the landlord if I tried; do you think that if the home office checks my name against that address and it shows that the council tax bill wasn't in my name; that could be a problem?. It was paid by the landlord, it just wasn't in my name, because my agreement included everything in the rent. Has anyone been in the same situation?

Hello Derivaz,

I think it shouldn't be a problem if your on a sharing basis as when you apply for BC you just need to show the address where you where living. most people living on sharing accomodation have the same circumstances so the HO knows that usually the landlord pays the bills.
Secondly in case HO questions then your pay slip + P60's should have your address on them or any other mail proof that you can also show should be enough to convince the HO.

Thanks for your reply; proof of address won't be an issue; I have all the P60's, letters of employment and bank statements; they all have my address on it; I was just worried in case the HO might think there was something dodgy going on if I said I lived at a particular address and the council tax at that time wasn't in my name, but like you said many people are in that situation, I think.

I'll apply this week then; from what I've read here, most applications are taking under to months to be approved, except for some Middle Easter countries right?

So, since I'm from an E.U. country would I be right to expect it to be approved before mid September if I apply now?

Ha, I wish I could apply this sentence to my case :lol: We applied on 13/06 (joint EEA+non EEA fam.member application) and are still waiting. Both applications are straightforward. My name on the acknowledgement letter was written wrongly so I emailed them to raise my concerns. They emailed back (again addressing me with a wrong name!) after 4 working days saying that the name in their data base is correct and saying that application is still being dealt with and that they can't give us any updates. Is it so difficult to get four letters of a name correctly?! :shock:

Anyways hopefully we and everyone else will get our approvals soon - I get very cross when I see that some people get their approvals after only couple of weeks, not cause they got it, but because we didn't :D

Also, joint applications might take longer; also depending on the nationality of the non-EEA person, but they replied to you, so that's a good sign :)

I'm not bothered about the length of the process; I'm not in a hurry, I just wouldn't like a letter to get lost and get my application refused because of that or miss the 3 month deadline for the ceremony, because the letter got lost and then have to re-apply, etc...

Yes, I agree, not in a hurry either but would be nice to get it sooner rather than later. Non-EEA national is from Serbia, and I've seen EEA/non-EEA joint applications including children being dealth with within 2-3 weeks. Why-oh-why can't we all have the same processing timeline? ;) As I said our both applications are straightforward - we probably got assigned to a lazy officer that likes to hang on his fb page a lot :D

Is the EEA RC Card a form of ID for the BC Ceremony?

My BC ceremony is due in the next few days. Will a Residence Documentation/Registration Certificate for a National (me) of an EEA State be considered as a form of ID?
My passport is with the HO (my wife applied for a PR Card) and will take time to be returned.

The Registration Certificate I want to bring to the ceremony has a photo (printed by HO) my name, my date of birth, place and date of issue. On one of the pages I wrote down my address, as required.

I'm not 100% sure, but I don't think the Permanent Residence or Residence card is considered a form of ID; every time I've asked, they've told me to bring my passport or National EAA ID; so in your case, I'd take your National ID as well; if you sent the passport, you should have a National ID and if you are EAA, that would be enough.

I'm not 100% sure, but my experience has been that only the passport or national ID are considered proof of ID; hope it helps.

I've called the council's BC Ceremony team. They have confirmed they accept the Residence Registration Card without any problems as it confirms my identity.

I have just attended the ceremony yesterday, they dont ask for any ID apart from your Invitation letter.
