Are we ready for naturalization via AN form?

Post by ipolcat » Thu May 30, 2013 1:18 pm

Hello,
Soon we are going to Nationality Checking Service for AN form submission. Before that I want to clarify some of the things and to see if I am right in my assumptions.
I am A8 national without any of ILR, citizen card or WRS (Working Registration Scheme certification) as I have been legally working in UK for more than 11 years now. Because of that apparently I don’t need any of those certifications but I got P60’s for all that years instead.
My wife joined me in 2004 and we married in 2005. From that point she was on and off from her work due to maternity with first and second daughter and some college between it. She managed to get WRS certification but that was in 2010. She is currently working part time.
We both passed Life in the UK test.
Based on that we want to apply for naturalization via AN form for us and older daughter via MN1 form. I believe I have got exercised treaty right by continuous full time employment where my wife will be exercising this as a family member EEA national. The same will apply to my daughter.
So is that correct? Is there anything which I am missing here?
Any input will be appreciated.
Thanks

Were you children born in the UK and when?

Yes, you and your wife have settled status - permanent residency, after 5 years of being a qualified person (exercising treat rights/family member).

Thanks for your reply. Both of children were born in UK; first 2005, second 2010. Based on current rules the younger daughter has already received British citizenship. Now we want apply the same for older one via MN1 form.

I hope our case is straight forward and we won't encounter any nasty surprises after paying around £2500 for all applications

To strengthen your case you'd be better waiting till you are British before applying to register your child as it's relying on discretion.

As the child was born in the UK, the application is by entitlement (section 1(3)) and not discretion. As you have settled status (automatic PR) the application will be approved regardless of the outcome of your application.

I suggest you explain on page 13 why you were exempt from WRS just to remove any doubts the caseworker might have.
