Hi guys,

I have a bit of a tricky one. I applied for ILR under the new SET (LR) application in April. My current leave to remain is a Tier 1 work visa. However, I have since changed jobs and my new employer needs me to travel abroad in the next month. I was hoping to have my new employer send a letter of request my case be expedited but I'm afraid they then might reject my application on the grunds that I am no longer in the UK under the same working conditions. Please advise! Also, would love to hear dvice on the best port of call for requesting expediton if that is a possibility.

From my understanding of the rules, Tier1 visa allows you to work for any employer of your choice. While your application is being decided your Tier1 automatically extends till you receive a reply for your application with HO.

I do not think anyone, except perhaps MP letter, can expedite your application. So any travel plans you have will have to wait until such a time as you get your travel documents back, or you have to cancel your application and get your travel documents back.

Sorry, It's actually a Tier 2 work visa! I was sponsored by my last employer

OK, please provide more details then. Is your new employer sponsoring you now? As per rules the old employer will let HO know you are no longer employed by them and hence revoke your sponsorship.

I sent in my application for ILR while I was working under a Tier 2 visa. Since then, I was made redundant and offered a new job at a different company which I have since taken up.

For my understanding, until your ILR application is decided you are considered on Tier 2 visa. So has your new employer issued you a Tier 2 visa? If not your old Tier2 visa is no longer valid because your sponsor will cancel it and you are no longer allowed to work in UK.

Please wait for more senior members to respond. Provide as much detail about your case as possible and the criteria under which you have currently applied on SET(LR).
