As I said above, Immigration and Nationality applications are exempt from Rehabilitation time periods.
Section 140 LASPO wrote:140 No rehabilitation for certain immigration or nationality purposes

Before section 57 of the UK Borders Act 2007 (and after the italic cross-heading before that section) insert—
“56ANo rehabilitation for certain immigration or nationality purposes

(1)Section 4(1), (2) and (3) of the Rehabilitation of Offenders Act 1974 (effect of rehabilitation) do not apply—
(a)in relation to any proceedings in respect of a relevant immigration decision or a relevant nationality decision, or
(b)otherwise for the purposes of, or in connection with, any such decision.

Yes, but Immigration and Nationality applications will be exempt as per s140.

you are right but change is coming in December i think.
I know someone got ILR from tier 1 within one month of the motoring conviction fine + point by the court.

the same person is planning to apply for naturalization shortly with the conviction which is serios offence, recklessness in nature.

From what a read in the guide a non custodial conviction takes 3 years to lapse; i guess that includes all non custodian convictions...

Hi Guys.
I have one more question.
I been working from 15.03.2007(WRS)UNTIL 20.01.08 for a agency.Then I start my own mobile therapy business from 15.03.2008(Revenue registration).From 2007 March until Now 2013 I been just 45 days without work.
Was time when I been preparing all for my own business.
I get my registration certificate(blue book)26.09.09-and 11.04.12 Permanent Residence.

Do you think that this 45 days without work(i"m not claim any benefits ) can refuse my application?
Thank you so much for a help.

And one more question.
I need some special document to show evidence of lawful residence during the 5 years before the date of application???

If you have the blue card (PR card), I take it you are EEA, so if you have PR, then you don't have to prove treaty rights if you've had it for a year, so you just need to prove residence for 5 years; I've submitted P60s and letters of employment for that, not sure what else you can use, maybe bank statements.

Regarding your last question, I think so, although they can check if you show your passport (I think the record it at customs); so I'm not sure, what you can show; ask the NCS to ask the HO via their internal line....

I do not have p60 because Im self employed.I do not have any stamps in passport because Im EEA.

But maybe anyone are self employed and can tell me how they show evidence of lawful residence???

if you are self employed, don't you have to fill in a tax declaration form every year or something like that?
That's probably the equivalent of P60s for self employed people; I'd submit bank statements as well; I think that would suffice...

Naturalisation Referees...

I am going to apply for naturalisation, I have some question re the referees, I would appreciate someone can answer.

I understand what the requirements are in place for referees, one should be person who has standing in the community and other one can be any British citizen over 25 years. I have got a registered nurse for professional nurse the second one is a bit confusing he is living with my sister in law they are not married or not civil partners, can he be a referee?

sounds like he's not related to you and he doesn't live at "your" address, so he's fine, the guide says it can't live at your address, not at your sister inlaw's address. Btw, you should post this in the refs threat
