Post by Umer Piracha » Fri Mar 27, 2015 2:41 pm

Sorry, re-posting this as I didnt get any reply.

Hi All,

I would like to know if i need to declare the below fpn scenario?

I did receive some letters from bailiff in December 2013 stated that I owe them 700 pounds as I did not pay my penalty to Ealing council. I did contact to Ealing council and explained them that they have been sending all paper work to my old address so therefore they should waive all the charges and send me new fpn (pcn) to my new address but they refused and advised me to contact TEC which i did and filled a N244 form. I received a letter from TEC that my case has been forward to court long story short Judge ordered the Ealing council that they should stop the bailiff and re-issue the ticket and give me rights to challenge the original ticket. I did not challenge as I did park on loading bay at 9:30pm as i wasn’t aware that time so I paid original ticket fee to Ealing which was around 60 pounds something. Everything was sorted in May 2014.

Now my question is that I went to court and challenged the bailiff and found not guilty. Do I need to mention this in my application?
Also I had 3 points in my licence back in Feb 2008 due to taking wrong turn in Central London and police gave me 3 points and fined me on spot. Since then I didn’t have any points and its all cleared now.

Thanks for your advise

Regards, Umer

PS:
Sorry forgot to mention that it did happen twice.

First time i paid to bailiff (back in 2010 ticket issued from Hounslow Council) but 2nd time i challenged them as both time ticket was issued during move to one house to other. First time i wasn’t aware of any law which could stop bailiff so i paid them as they were harassing.

Please let me know if I need to mention these two scenario

thanks

Hello guys, please i need a quick advise. I have just sent my application for citizenship 3 days ago at wandsworth NSC. In 2012 i was convicted and sentenced to 100hr community service. My major problem right now is that, the conviction will only be 3 years old in about 25 days. what do you guys think will most likely be the outcome of my application? will my application refused outrightly or do you think the caseworker will possibly use discretion since its only few days before it becomes 3 years.

Anyone ever been in my shoes before. i would have waited but i clearly didnt know this was the case as i had applied for FLR(M) AND ILR(M) and they were both granted. i didnt know a 3 year rule was required for citizenship. Please any advise will be welcomed.

Thank you

Hi all,

I wonder if someone could help urgently, please.

After graduating from a UK university with honours degree in 2005 I made a mistake of doing post graduate diploma from Cambridge College of Learning in 2007, instead of doing Masters from another university.

A mistake that still makes me feel very ashamed of myself, as I received my post study work permit in early 2008 - but by the end of 2008 college was blacklisted due to corruption.

I never received any letter from Home Office but instead of wasting time, I applied for high skilled migration in 2009 using my university degree and work experience - it was approved.

While on HSMP, I was married and my wife is British born citizen. My spouse visa was granted and also my ILR after three years.

I have applied for Naturalisation and did not mention about Cambridge College of Learning, but after not received any decision I tried contacting Home Office.

They replied :
“Greater levels of scrutiny will be applied to certain applications.  This will be dependent on certain indicators within their immigration history that pre-date the application for naturalisation. Your case has been identified as such a case.”

I did my research and aware of the fact it is a generic email and Home Office is under huge backlog.

Yet, it doesn't help me to think and go paranoid. My questions are :

1. Can Home Office allege me of deception or suspicion and ban me from applying Naturalisation for 10 years?

2. Can Home Office revoke my ILR and deport me?

This was the one and only mistake I did in my entire stay in UK, never committed a crime, no speeding fines or even fracas. I have discussed options with my wife and family that should Home Office revoke ILR, we would have to sell our house and either move to Canada or else where. It is just not fair on her and she doesn't deserve it if this happens and I'll never be able to forgive myself.

I'd appreciate if someone could suggest or advise, much obliged.

Thanks,
Siraj

If it is clear then it is clear. Next time remember do not give anything to those TV licence goons even if it is your own home. I personally would not even talk with them, just slam the door

Unfortunately neither will be acceptable, as they are both related to you. Please read the AN form & guidance for referees carefully.

Hi Amber , Vinny and senior Members,

Im still struggling to find Clear solution for below Please. This was posted earlier as well, but I think this is the right place to quote.

Few months ago,I was arrested for a night and DVPO was issued by Magistrate court to stay away from my Family/home for 28 days. One of criminal solicitor said Its just new civil provision, but not a conviction or caution. This is just precautionary act under suspect and dont need to declare on applications.

And also police document says, A DVPO must be in force for 14-28 days. A breach of a DVPN/O is not a criminal or recordable offence, and as such, there is no power to take fingerprints, photographs or DNA.

Im waiting for Subject access from police records and hoping to arrive in couple of weeks. In means time,

1)Do You think I should Declare DVPOs, As I dont want to if I dont have to and remains application free ?
2)If I need to declare I dont think there is a right place to declare (Subjective Sec 3.19 sounds different) apart from Further information box.

DVPO is a new provision and hard to find advices and experiences and most not aware of this provision either. :?

Any Experience or Advice Please share.

Dear Forum ,

Please advise soon I have to apply for citizenship application. I mistakenly claimed Child Benefit allowance in 2010 for few months however same year informed HMRC to stop this payment as not entitled told them later pay back as well after further correspondence. Declared this issue in last two Tier 2 extensions as well clearly however no problem was faced for extension of my Tier 2 visa by Home Office. Got ILR last year on same day service do i need to mention this issue in my Citizenship application otherwise nothing wrong on my records till to date. Feeling low if this issue will delay my citizenship application. PLus one more thing once i was stopped by UK Customs for bringing mangoes from outside EU so i was issued notice of seizure of goods do i need to declare as well as they told me this is first time we dont take any further actions .

Regards

Hi there, if any one can help.
I got my ilr in december 2013 but in january 2014 i did receive a pnd for shop lifting. Basically, it wasnt shop lifting it was a mistake as i got a phone call of my mate and i had couple of shopping bags and i had a top from the store but i was on the phone to my friend and telling him where i was and i stepped out of the store without realising i had walked out and i got wrong for that. The police where called and i did explain them what had happened, they did check my existing records and they told me it was all clean but they had to issue me a pnd for this thing and explained it wasnt a conviction nor a caution, its something like youve been naughty and that you dont repeat it again but it will be on police computer. i paid the fine straight away.
Now the question is will i have to wait 3 years or can i apply now as it has been over a year now and never in me life such a thing has happened and i dont know how i committed such a mistake.
Please if someone can throw some light on this.

thanks

Hi Amber i saw this old post Please advise me i want to apply for naturalisation my case is same like this but bit different when i applied in 2008 for psw visa with ccl diploma i was granted the visa and i didn't get any letter or notice from home office. i went back to my country before visa expiry i got married with my british spouse in 2011 i got visa from home country and ilr with no problem and i didn't mention anywhere about this in my previous application Please suggest should i tell home office about it. is there any chance i will get naturalisation thanks
bilal12 wrote:Thanks D4109125,
It was a diploma from Cambridge college(I guess pretty famous scam) which was found to be false. I could have proved myself innocent if had been given a chance to appeal!

However as I mentioned in my previous post they had stated in the refusal letter:
you have extant leave in UK until 15 December 2010. before the expiry of this leave you should either regularise your stay here or leave the UK on your own expense. If we have to remove you, any application for entry clearance or leave to enter that you make will be refused under the immigration rules for at least ten years.

So as I have regularised myself, doesn't this mean I don't fall under the 10 years ban? also they had mentioned that they even then they will not refuse my applications if my applications are of spouse or being married to a BC.

Hi Sohail,

You need 10 posts to be able to send private messages.

If college was banned for corruption after we left then it is not our fault and which is why Home Office never contacted us, same reason Bilal12 received his naturalisation.

Said that, if Home Office go beyond reasonable doubt and allege with deception – then they have to prove it and college being closed it is almost beyond impossible to.

Why not contact Home Office and request if this can affect? I personally never thought this will be an issue since they never mentioned it while I applied for HSMP and Spouse Visa and ILR.

If I get naturalised I will let everyone know like Bilal did, if I don’t then I will let everyone know as well.

Kind regards,
Siraj

Depends what the circumstances surrounding your bankruptcy were? Have you read the FAQ?

Yes I did read the FAQ and this is why I'm asking .. my bankruptcy was for a personal reasons ( divorce , illness ) and was discharged 10 months after the bankruptcy order , amount was £30K and all were personal loans and credit cards no business involved .,,

the question is have any one you guys knew or heard of been approved after bankruptcy ? I can't find anything in the whole web but the FAQ only ... thank you very much
