Subject Access Request SAR

Post by $uperman » Thu Jun 06, 2013 7:11 pm

Anyone have an idea how long it takes to get confirmation from the home office.

I sent my SAR request two weeks ago used 1st class stamp but haven't received any confirmation From the UKBA. I am not sure what is the best thing to do?

You should get confirmation within 4 weeks and it normally takes around 40 days to get the information you requested. If you sent it by recorded delivery you can track the delivery of the request.

Did you sent the request by recorded delivery?

Well, whenever you send cheques or bank details it should be by recorded delivery. Try and ring the ukba and ask if they have received your request.

I applied for SAR couple of years ago, took 20 days to get acknowledgement. I never bothered to check when the actual payment was taken. Actual SAR arrived in 50 days.

I would say that anything sent to UKBA, DVLA, HMRC and such must always be recorded delivery. This way there is no confusion and dispute whether the actual mail reached its destination or not.

Recorded delivery just costs £1.10 extra, and being held in que over the phone costs a lot more.

Thanks for the great info

In future I will always do the recorded delivery with certain gov departments. Excuse me for being so silly in past 6 years many times I changed address on my Driving licence whenever I moved to the different one but never bothered to sent a recorded delivery to DVLA but always got my docs on right time without any bad experience - see what happens this time :)

Anyway , yesterday I tried to ring them up but unsuccessful and eventually I managed to send email. Any idea what SAR file includes?

It will have copies of all the applications you have sent to UKBA. Plus it will have case notes by caseworker, and information from Case information database.

Do you have any immigration issues right now or any doubts about anything that happened in past, or are you just curious?

Thanks for the info

I am just curious what info they hold about me. I got refugee status last year and at the same time married to a British citizen so wondering if I get an exemption in order to qualify sooner for British citizenship.

Also while I was not allowed to work in the UK I got stuck in some debts and that might have lead to the CCJ , I wonder if its in their record as well?

It will take another 4 years before you get ILR.

Once you get ILR, you can immediately apply for British Citizenship. You will not need to wait for one year after ILR, and this is the "benefit" if you like of being married to a British Citizen.

Another benefit of being married to a British Citizen would be that if you travel to another eu country you will get a free visa and won't need to provide ticket details, bank statements or hotel bookings etc.

CCJ wont just have happened without you finding out. The court does send you papers which clearly state what they are.

If you still want to check if you have a ccj, then you can check on trust online website. You must supply accurate details about yourself including the correct address at the time when you think ccj might have happened.

Does CCJ for unpaid debt effect on ILR or naturalisation?

For ILR if you show no intention of paying debts that is a general grounds for refusal.

For citizenship see British Citizenship – Good Character Requirement FAQs Qs 17 & 19

I will certainly pay once I have money coming in , but it's been now over a year I am on JSA , so can't afford anything at the moment...

Once I find work and have a regular income coming in then definitely pay off the debts and in future never get any bank credit card etc ever in my life , it's worth having small regular income rather then buying credits from banks

in between recently I had my enhanced crb for last six years and its absolutely clean , non of the CCJ is recorded on it

Even if you have 100 CCJ's, they won't show on CRB.

A CRB check relates to criminal issues, a CCJ is a civil offence. You should contact the National Debtline or your local CAB.

Have you got your SAR?
If yes how much time it took in total?
And what kind of details are included on it?
Thanks,

Yes I got it eventually.. It took altogether 50 days from the date I submitted the application. I sent the £10 cheque but the didn't charge me anything , ad I have refugee status hence I presume they don't charge refugees.

It contains basically all your immigration history from beginning and all the applications and paper work you have submitted etc and some hand writhing notes etc

Does it contains entry and exit dates for the period when you travelled outside UK?

I am applying for ILR. I am not sure of my travel dates as I have been in and out of the UK many times in the past 5 years. If I send a request will they be able to tell me exactly what dates I left and entered the UK?
