in terms of the suitability and financial requirements

i would be meeting my solicitor on tuesday to see the way forward,my question is would it be worth while going for JR because i submitted more than 2yrs cohabitation ,pay slips of my wife etc etc or i would be better of returning back to my home country to re apply a spouse visa there....would my overstaying go against me?

If you met all the requirements then why did you not leave the Country and apply outside the UK? Moreover, the time to settlement would be half, 5 years instead of 10.

my solicitor made me to believe she certain i would be ok because we have been living 2gether and bcos my mrs is working i would be granted under the human right law,i only got married after we had submitted the application,in the main application we submitted all the cohabitating docs,her passport everything i can think of. can JR lead to me being granted or i would be better of going back to my home country to re apply.if i decide to go home would my overstayer status go against me pls.

Well considering the route to settlement will be halved and that you meet the requirements (ensure you do) it may be wise.

thanks again for s quick response,i have just had a look at the link you sent me.i ve 3 further questions can i reuse the english language text i took with trinity back in my home country it expires 2 years time is a(A1) ,wont my overstayer status be used against me and can i go alone or i would ve to go with my wife

Providing the test is on the approved list (click) and is valid that should be fine, you can go alone and you should be granted leave providing you meet all the requirements, overstaying alone should not indicate a refusal.

Hi D4109125,

please i ve 2 more question regarding my out of country application,does my wife has to have extra money in her saving despite the fact that she qualifies for the 18,600 from her income?
And could u also pls advice me on forms and appendix i need to fill . Thanks

Applied for my wife on Feb 2012, who was student and I was on work permit, it took HO about 13 month to refuse the application on March 2013, but gave right to appeal. Appealed and prepared the case witness statment by myself and appear in the court.

Case was heared on 4th Sep 2013 and today we got the decision from court and our appeal was allowed on immigration rules and article 8.

Now waiting for HO to make the right move.

can u pls clarify this for me pls

A letter from the employer(s) who issued the payslips at paragraph 2(a) confirming:

(i) the person's employment and gross annual salary;
(ii) the length of their employment;
(iii) the period over which they have been or were paid the level of salary relied upon in the application; and
(iv) the type of employment (permanent, fixed-term contract or agency).

can u pls explain (iii) i would be using 6months payslips so would the letter need to confirm how much my wife has earned 6months prior to my application?

Yes that during the 6 month period you have been paid the amount you are relying on, for salaried earnings under Cat A, then at least £1550 Gross per month.
