Hello

I need some advice for a potential situation.

We are waiting to hear the result of my brother's wife Spouse Visa Appeal to join him in the UK. My brother is British by birth. His baby was born in Bangladesh and is therefore British by descent.

In the event that his wife's spouse visa is granted in the next 2-3 months what's the best way my British baby niece can join us in the UK.

It takes a minimum of 16 weeks for a British Passport. I've read the post here: http://www.immigrationboards.com/viewtopic.php?t=134125

where it's suggested that one could apply for an Emergency Travel Document, however it's not clear whether these documents are granted for those without any travel documents (i.e. without a passport).

If wife's visa is granted, my brother will go to Bangladesh to bring over his wife. Do you think going to our local MP with a letter of support might help? It's not possible to leave baby behind with extended family.

The alternative might be to apply for a Bangladeshi Passport and apply for a UK visa, however I'm not sure if this is possible, what visa would we apply for and how long might it take to be granted.

Any ideas is appreciated

Do you think it will be worth registering the baby's brith with the BHC so we have the long brith certificate and then use that as evidence for the Certificate of Entitlement of ROA. I had a quick look at the form and one question is nationality, what would they put down, British or Bangladeshi?

OK, I have checked in more detail and I have the answer to my question.

I have one more question, is the application for Certificate of Entitlement to Right of Abode considered to settlement or non-settlement application. I'm trying to get an idea of how long it might take. I think it's considered non-settlement but I would like to make sure.

Where does 16 weeks come from? I applied for my daughter's first passport shortly after she was born on 21st December at the UK Passport centre in Hong Kong. I went in person but posting it would only have added the time it would have taken to get there. The passport arrived with me in Guangdong China exactly 3 weeks to the day after I submitted the application, that was with Christmas and New Year holidays being included too. We didn't do consular registration of birth either, just used the original Chinese birth certificate. The max time for a first application abroad is supposed to be 6 weeks, they told me 4 weeks at the consulate but it arrived in 3.

I think it depends on the country. When you go to the website and put in the country details it gives a figure as to how long it will take. For Bangladesh it says a minimum of 16 weeks.

Edit: I just checked the website for china and it said 6 weeks, so it really depends on the country

Please keep in mind its "minimum" 16 weeks. If it gets tangled then it could take an eternity. Sometimes due to travel history and other factors, if they become suspicious of the child father really being of a british , they may even ask for a paternity test. More corrupt the country, more rigorous the procedures and waiting time for passports. In hong kong, you can't just produce a birth certificate. In bangladesh, india, pakistan, nigeria and many other countries anyone could pay the right money and get a birth certificate issued with any details on it.
