15 or 10 or 5 years for Tier 1 G -> ILR

Hello Everyone,

I'm on Tier 1 G visa and would like to apply for ILR. How many years of stay you get 15 or 10 or 5 years if you applied by POST and at PEO? I was told by my agent that if I applied at PEO I would get 5 years. Is that right? Please throw some light on this.

ILR is for life, it doesn't have an expiry date. The BRP card does have an expiry date (same as your passport), which is 10 years after it has been granted.

I don't understand your question!

Biometric Residence Permit is your visa.
Visa can be valid from short term (6 months) to long term (indefinite).
The card itself, as any other document also has an expiry date. The longest the card is valid is 10 years.

So, if you obtained for example ILR which is granted fro life (unless revoked) and never went to apply for British citizenship, you will have to renew the card every 10 years. Like your passport

What did you agent tell you?

If you stayed in the UK for 5 years on Tier 1, you can apply either at PEO or via post for ILR. It doesn't matter which route you go for, you will get an ILR which is valid for life.

If you stayed in the UK for 10 years on various visas, you can apply via post for an ILR.

10 years expiry date showing on BRP is a standard format like a national passport has date of expiry. ILR is a settled status and is for forever unless being lost with 2+ years absence.

But, being curious. Why not if somebody stayed in this country for 10 years can't apply at PEO? I think this is what my agent told and I'm mixing up. Sorry!
