I have OBVIOUSLY already checked the ukba site but in the past i have seen 2 different versions of that list and i was wondering if someone could send me the link to the latest one so that i can confirm i am looking at the right one.

Yes, that link/document you posted is valid - it applies to work permit holders; Tier 2 (General), Tier 2 (ICT), Tier 5, Tier 1 (Entrepreneur) etc.

The link I posted is the official Shortage Occupation list mainly for the Tier 2 of the points based system (which is what I believe you requested for in your original post). This official shortage occupation list is what would be used to assess all Tier 2 PBS applications.

so which one is the valid one now:
I have got these two documents and i am wondering which one is valid for me: I am currently a Tier 1 Post Study Work Permit and i am now looking to apply for a Tier 2 (General) Work visa.

One of the list is called: Codes of Practice for Skilled Workers and you can find it here:

The other one is called: shortage occupation list and you can find it here:

The shortage occupation list seems to be a subset of the other one and it does not have my current job title but the codes of practice for skilled workers file has my job title.

I would appreciate if someone could shed some light on this issue for me.

Hi divesh777

Both lists are valid for you. If your sponsor (employer) offers you a job which IS on the shortage occupation list, then you will automatically score the full points (50 points) for 'attributes' and will not have to score enough points for 'Prospective Earnings' or 'Qualifications'.

If you're offered a job that IS NOT on the shortage occupation list, the job offered to you would be assessed against the Codes of Practice for Skilled Workers list and the employer will have to show that a 'Resident Labour Test' had been undertaken - in your case your sponsor will be exempt from this test as you are on a PSW and have been working with them for at least 6 months so you automatically score 30 points if you have a Certificate of Sponsorship.

To get the rest of the points for your attributes (20 more points to make a total of 50 points), you have to make sure that the job on the CoS issued by your employer has the 'appropriate salary' or higher.

Implication of switch from Tier 2 dependent to Tier 2 sponso

I am currently on a dependent visa. My husband is on a Tier 2 general visa. My employer is in the process of issuing CoS to me. So, I will be switching from dependent to Tier 2 sponsored status.

Can you please clarify the following:-
a. On receipt of CoS, do I need to apply from India, considering I am moving visa category from ‘dependent’ to ‘Tier 2’?

b. From a PR perspective, does the counter on 5 years get reset for me from the date of this CoS?

c. Will the visa be of the same duration as the CoS?

d. Is there any implication on visa or CoS, if I move to other roles within the same sponsor employer during the validity of this CoS?

b. From a PR perspective, does the counter on 5 years get reset for me from the date of this CoS? the ILR clock will start on the date you enter the UK as a T2 migrant

c. Will the visa be of the same duration as the CoS? the duration will be 3 years or the period given in the CoS, whichever is shorter

d. Is there any implication on visa or CoS, if I move to other roles within the same sponsor employer during the validity of this CoS? there may be, see para 194 and onwards in the T2 policy guidance
