Overstayed my PSW visa for 3 Weeks & Want to get Married

Dear Friends,

Here is my situation :

Overstayed my PSW Visa for 3 weeks and want to get married to a British girl.

Would anyone please advice if it is possible, just to let you know that COA is not required any more to get married in the UK.

Will be eagerly waiting for your replies!!!

Yes, you can get married, if permission to marry is the extent of your enquiry.

Is this what I need to follow please?

1. Get a registration date.
2. Register your marriage.
3. Get a marriage certificate.
4. Fill up FLR (M).
5. A Joint Account.
6. Her and Mine Payslips.
7. Send all documents to HO.

I have got around 6,000 GBP savings and as far as I know she is earning 18,000 GBP annually. Will this be of any help?

If you are an overstayer you may face arrest and deportation if you try and get married in the UK.

Thank you so much for your help Guru. Yes, I have overstayed my PSW visa for 3 weeks now and want to get married with my British friend she has got Portuguese nationality as well.

Going back home and applying for fiancée Visa will be a nightmare for me because my employer has put me on hold and can't help me in any other way.

That would be my last question, if you could answer it. May I go for the EU route then?

You can (try to) get married, but there is a real risk of getting arrested at register office, and put back on plane back home.

You cannot use EU route as your partner is a British Citizen.

If you do manage to get married then you can either go back to your home country and apply for spouse visa from there.

or

Go to another eu country, and after your partner exercises their treaty rights there for some time, come back to UK under eu surinder singh route.

when ho said 18600 it means salary not saving and of course you can use your saving to top up, but it is using a different calculation when it comes to savings

in your case, your wife making 18000, this means you are 600 pounds short, and in this you will need (18600-18000)*2.5 +18600 = 20100 savings to cover the 600 pounds short salary.

BTW, your wife is not a UK citizen or she does not have ILR, i think in this case you need to go thourgh EEA, not the uk spouse visa

He is technically an illegal immigrant right now, so cannot use this earnings, and the question does not even arise as he cannot apply for a spouse visa from within UK anyways.

And his wife is a British Citizen, so eu route is not possible either. :wink:

overstaying does not apply on Spouses...

Best way is to leave the country on your expense. Get married back home and then Apply...

If you try getting registration done in UK, you are risking it ...

I have starting wondering how come illegal immigrants marry here in the UK. I have got a very good educational, financial and have never been convicted. I have paid all my taxes and everything in the past 7 years. Why are these rules so strict for me then. To be honest I don't find worth living here when I think about all that.

She should move with me to Pakistan, for her good!!!
