CTC, WTC, HB, CTR while spouse FLR waiting

Post by z18runway » Wed Jun 26, 2013 1:17 am

Sorry to ask this question as this has been answered for others members for number of times, but as my personal circumstances is a bit different, I had to create a topic.

I am on ILR, wife FLR(m) decision pending, she is under old rules, so once she gets FLR, she will apply for ILR under set(m).

Now my question is :

1) can I claim CTC, HB, WTC, Council tax reduction ?

I have already applied for CB for my 2 children under my name.

2) Will my wife's FLR(M) or SET (M) be affected if I apply for tax credits and HB ?

3) Will a question arise when my wife is applying ILR ,'how can your sponsor support you when he is already receiving public funds?'

As senior members say, making as joint claim and getting single claimant money wont affect wife's application.
(My situation is - we don't fall under financial requirement rules and sponsor working 24 hrs/week (£8500 pa), rent £500. Is this money enough to support my wife's application ?)

Claim child benefit in your name, tax credits jointly. Regarding hb and Ctr I would avoid these until your spouse is settled unless you can be certain that you will only receive a single person applicable amount, local authorities are notorious for including couples, the choice is yours.

Adequate maintenance in your case would be around £245 per week Net income after rent is deducted. You can include tax credits and child benefit in the income, so get the claims in.
