My Husband has been denied a UK family visitor visa - HELP!

Post by london13 » Thu Jun 27, 2013 8:26 pm

Hello. I am heartbroken, I found out yesterday my husband's visitor visa has been denied. The reason we were applying for a visitor visa is that I currently don't make the required £18600. I will from next month so after 6 months we can apply. I already haven't seen him in 4 months. The reason they refused was they didn't believe he would return to the US. We did not supply enough documents apparently. He has a flight booked for mid July. Would it be crazy to risk just trying to get through immigration and getting a tourist visa? He will be flagged now that he has been declined. Could he get barred from the UK if he doesn't make it through? I don't know how it works. Please help if you have experienced this or know of any answers. Thank you

Given he's applied and been declined - it'll flag up on arrival.

They'll then want to know what's changed since the application to mean they now think he will leave.

The answer - from what you've put - is nothing!

So, personally, I'd expect him to be turned around at the border. But you might get lucky if he decides to chance it.

He wouldn't be banned from the UK if he does get turned around - but his spouse application might come under a little more scrutiny.

Thank you for your response. I'm in a panic about it all, which doesn't help. Do you know, if he came, and was refused...does he have to but a ticket back himself? I wish I knew what our chances are. I've tried various immigration lawyers but they don't advise much on this matter as they are mostly concerned with applications (understandably). I don't know if we have 'nothing to lose' at this point or if in fact we'll regret it down the line...

No - he'd be returned at the taxpayers expense.

You have to make the choice as to whether it's worth trying or not.

Personally - if I knew my spouse was likely to be turned away - I'd probably advise her not to travel. As hard as it is - you have to focus on the long term goal - and I speak as someone who was in a long distance relationship for 3 years with gaps of 6-9 months between each visit.

Thanks M, I really appreciate it. We're nearly at 3 years now too. We got so close but just got to pick ourselves up and try again. It's brings you closer in the end, all that living in fear of constant immigration rule changes and price hikes.
