Sweden EU family Permit or PR

Post by marshallin » Fri Jul 05, 2013 11:13 am

Hello everyone

Would highly appreciate if someone could guide me on following situation for
Sweden.

Husband : Swedish Citizen (holding UK EEA Permanent Residence Card).
Self : Indian Citizen (holding UKBA EEA Residence Card as "Family Member of EEA National")

We have been married since Oct'11 and I have been resident in UK with him since Mar'12.

My husband has now received job offer in Sweden and we are considering move there.

I understand I am eligible to apply either for Swedish Residence Card or EU Family Visa. Also since my husbands job is new and has probationary period of 6 months I am planning to move to Sweden on his completion of this 6 month period,

My query is am I eligible for Swedish PR If I apply after completion of my 2 years marriage or can I still also consider applying under EU Family visa
route if I do apply before completion of 6 month period residence in UK, whilst my husband continues to remain in Sweden. He would be commuting on weekends between Sweden and UK.

Appreciate advice.

Mthks

You have the choice between the two routes.

I don't think there is a requirement to be married for 2 years for the Swedish family route.

The national route costs money and the waiting times can be several months. However, it will give you a faster route to Swedish citizenship (3 years compared to 5 years under the EU route) if you are after that.

As long as your husband is not absent from the UK for a period longer than 2 years, he will retain his UK PR. Keep it in mind.
