Stay after Tier 4 and Tier 2 sponsor's licence renewal

Post by shahbaz1 » Fri Jul 05, 2013 11:39 am

Hi, Could you please give me some advice regarding my problem. I will start from the beginning so that you can have a good idea of it.
I was given a tier 4 visa in 2010 for an MEng course at Leeds University which was to end on 1st July 2014. However, I finished my studies with a BEng and the university has informed the UKBA that my new completion of studies date is 1st July 2013.
I also got a job here in the UK but my company is renewing their tier 2 licence and they started the process on 1st July 2013.
Now the problem is that I am not sure if I have 60 days of time in the UK after 1st July 2013 or the usual 4 months after completion of studies as I have done a course which is more than 12 months long. Also, I am not sure if my employer will give me a certificate of sponsorship on time or not so that I can apply for a tier 2 visa.
Kindly tell me about the time I have remaining in the UK, is it 60 days or 4 months after 1st July 2013? Also, will my employer be able to issue a certificate of sponsorship while they are renewing their tier 2 licence and how long will this renewal take as they are an A rated sponsors already?
If my employer is unable to provide me a CoS on time, then what should I do? Should I overstay and then apply for a tier 2 visa as soon as I get my CoS? I am aware that I can start work with them in August on my tier 4 visa.
I will be waiting for your reply.

Kind Regards
Shahbaz

No need to worry at all.. If you haven't heard from UKBA, you are safe and the 60days has not started counting. Having said that, make sure you have your supporting documents to switch to tier 2 ready while your employing company is sorting out COS for you. Same thing happened to me last year, finished studies six months earlier and uni wrote to UKBA

Renewal of the sponsor's licence should not affect you at all and it may just be an excuse by the employer to delay assigning the CoS. Make sure that they genuinely intend to assign the CoS and if in doubt look for another sponsor.
