Marriage

I have a friend who applied for tier 2 about 2 years ago. Visa got rejected and he appealed. He is still waiting for the verdict. It's more then 19 months now and he has found a girl who is British and they wish to marry. Now my question is to get married does he need to withdraw the appeal and get his passport back from ukba and reapply for marriage or can he just get marry without notifying ukba. Does anybody know what procedures are to b followed. Thank you
