Help needed!!! Divorce issue - Azad Kashmir

Post by Ali_mustafa » Sat Jul 06, 2013 5:58 pm

Hi everyone. I would appreciate any help/ advice provided.
I am a UK citizen (Born in uk). i recently married my wife in Azad Kashmir. However my wife has previously been married in azad kashmir, her ex-husband was a uk citizen and she had spent a year in the uk with him (so previously had a visa). After a year of marriage she was taken to Pakistan and given a talaaq and left their. It has been one year since she received the talaaq letter from her ex.

As the laws governing divorce in azad kashmir differ to mainland pakistan as it doesn't need to be registered with the union council.

I feel that this would be insuffient when applying for visa and the ukba asks for proof, especially because her marriage would have been registered in the uk when she applied for the visa.

Could you please point me in the right direction, would she;
1. Need to go through family courts in azad kashmir to get talaaq
2. Need a uk divorce (how would this be done?)

Thanks

Its clear that this divorce is not recognised in UK, so technically the woman is still married under UK law.

It appears that divorce procedures from azad kashmir will not bear results.

Don't take it as legal advice, but I think the best way would be that she starts divorce proceeding in UK court. I could not tell you exactly how, but you could go to county court to get divorce forms and tell them the background and many a times it happens that there is someone there who does give you helpful tips. You can also contact CAB, but I doubt they can be of too much help.

Another easier way might be, if she moves out from Azad Kashmir and into main Pakistan, and then starts divorce proceeding from there under MFLO.
