ILR Advice for Tier 1 - 2009 batch

Hi,

I am seeking advice for the ILR. Following is my track:

1. I obtained HSMP Tier 1 (General) on 25th Feb, 2009.
2. Arrived in UK after delivering my child on 7th Oct, 2009
3. Visited Home for 4 days in Sep, 2010
3. Obtained Extension on 30th May, 2012
4. Visited Home for 3 weeks in December [10th Dec till 2nd January]

Now shall I apply for extension or ILR in May 2014? In case if I will apply for extension can I still apply for ILR in Oct 2014 because thats where I will be completing exact 5 years of Tier 1 requirement.


Please advise.

In May 2014, you will need to extend your visa as your 5 year qualifying period was started from October 2009. You will be eligible for ILR in October 2014. Actually you can apply within 28 days before 7th October 2014 or after.
