Hi, me and my partner applied Tier 1 Entrepreneur via PSW in 10/09/12 and received refusal letter today 03/07/13. We already invested money last 16 months. Home office refuses our visa and writes down wording same for both applicants.
1-You have state that you are currently director of uk company. As evidence of this, you have provide a certificate of incorporation and IN01 (ef) from company house. However we are not satisfied that on a date falling within three months prior to the date of your application you were director of a new business.
2- You have submitted a contract between xyz Ltd and abc Ltd it does not specify the requirements set out in paragraph 41SD (c) (iv) immigration rule. We are not satisfied.
3- That you did MBA and your partner did MSc and how you can run IT/Computer Consultancy services.
4- Your advertisement is not on live.
5- Now I am going to appeal submission and I need your kind help. If I submit new CAR and Contract between two parties, will tribunal accept it or not and what is chance of win appeal.
Please help me, I pray you.

Dear I am sorry to hear about the refusal

considering the points raised by Case worker led to a refusal is something you can answer to before anyone else at this forum, as when UKBA says regardless of company age a director should be acting as a director or have not been disqualified from directorship within last 3 month immediate before you apply for the visa. you seem not to be acting as a director having your entrepreneurial team partner in this case you should know what your answer is going to be like. they then said MBA(Business Admin Degree) is seemingly not leading to a role you claimed you working at it is again down to you if there had been an interview before decision you did have likely been questioned about it.they continued and talked about the contract you provided did not meet the criteria what it means you did not include everything a contract should have as specified in the guidance.

if you have answers to above you should win an appeal provided a good lawyer soliciting your case if you look around within forum you would know these are very common objections potentially tackle-able.
