Spouse Visa Question

Spouse Visa Question

Hi All

My wife submitted her visa application at vfs Jalandhar in India. In the file we forgot to include our wedding card and receipt from the Gurudwara temple where the religious ceremony took place. Th person who went through my wife's documents said these are required as well and he's asked us to scan the documents and email it to BHC New Delhi.

Would this cause any problem if I have them to missing? I've included everything else i.e. Marriage certificate, wedding photos, screenshots from skype viber whatsapp etc.

I was reading on UKBA site that only documents submitted with application will be taken into account. I've emailed the documents anyway but if they don't accept these would it cause any problem?

Missing documents from applications is something that is recognised by the Home Office. There is a policy that was published in 2009, called Evidential Flexibility Policy.

This policy should be applied by the Home Office but they dont most of the time. If documents or information is missing in an application, and it is clear with the missing documents the application would succeed, the home office has to request these documents and require the applicant to submit them within a specified time.

So if you the applicant have identified the missing documents then you have done well and saved the Home Office's time and resources since they have to request the missing docs under the above policy.

I think if they refuse them you should request reconsideration highlighting the above policy

The thing is we are not missing any of of the important document. We have provided Marriage Certificate, Photos etc. My wife forgot to take the wedding card with her to the visa centre. And I've not read anywhere on UKBA site that Wedding card is a must document.

The person who went through her documents at the visa centre will not process her application. Her application will be passed to a caseworker in BHC.

So hopefully I should be ok.

I think the person who went through my wife's documents was just trying to scare my wife by asking unnecessary stupid questions lol. For example he looked at the Original Marriage certificate and asked my wife is this original when it clearly is and then he looked at the stamp on the certificate and goes what is this lol.
