My wife application PBS dependent to ILR

Post by currydixon » Tue Jul 16, 2013 9:46 am

[My Background:I have got my ILR in November 2012 through Tier 1 general category (HSMP 2Yrs + 3yrs Tier 1 general).

My wife: Married in January 2011. First time my wife visa granted as below.
Tier 1 General partner - June 2011 to Nov 2012
PBS dependent leave to remain - Nov 2012 to Nov 2015

Since my wife completed 2 years in UK (July 2011 to July 2013), she is eligible for ILR.
Could you please let me know following?
1. What application form she needs to fill in?
2. list of documents requirement.
3. Is there any minimum salary requirement ? I am on 21K/year, Is that sufficient?

Thanks in advance

Form is set(o) you'll need to show cohabitation proof since November 2012 and KOLL and be able to adequately maintain and accommodate for which your salary will suffice maintenance. See here (click)

One more question

My wife was away for holiday twice as below.

1 sister wedding - 19 days
2. family visit - 40 days

total - 59 days...

her 2 yrs completed as July 2011 to July 2013, But because of 59 days out of country , does she needs to wait until Sep for ILR?

In section 3 I am sure it says 'PBS dependent' does it not?

As the absences are limited that should be ok.

Thank you sir.

One more question in SET(o) --> Section 5---->
5.1 Is your home in the UK:
ans: (c) privately rented by you? ticked.

5.2 Do you or your partner, both pay any rent or mortgage for your home ?
ans: Yes , If so how much do you pay each month? £625

5.3 Are you working in the UK?
Ans: Yes

If so what is your pay each month after income tax and other deductions?
**** I am bit confuse***** my wife working an earning around 1000/per month after tax. If i enter this value and if It compared with rent by Case worker then it sounds too low. But i am working as well and earning enough. Should i mention total of our salary in this section?

Please advise.

Regards
Does it create

You should list both your incomes in 5.6.

Hi alll,

God bless you all, currydixon, Guru and D4109125

All the ans to my questions are being ansewred here for curry dixons.

Am exactly in the same shoes as Currydixon. got my ILr in jan 2013 via 5yr route(hsmp and 3 yrs tier 1 gen0. got married in March 2011, hubby granted dep visa and came into d the country in july 2011, extended pbs dep in jan 2013 and now due for ILR.
i earn more, so i clear that i should add my income and pay slip for 3 months along with his own payslip for 3 months. and ofcourse, cohad docs.

But my question now is do we need to show money in an account as maintenance fund ? say like £1200 for both of us?

will appreciate your repsonse as usual . thanks all

Hello D4109125

Thanks for your help.

Does it mean in section 5.3 , i should mention my wife income 1K/month only?

I am little bit unsure filling up Section 5.6. I feel it more relate to Tier 2 category as mentioned in form. Could you please confirm?

Do i need to mention my name (ILR applicant) in to application form? It seems there is no box for this, Do i need to submit my original passport/BRP?

Thanks

Nope not for Tier 2. 5.6 states sources of income the dep and main applicant are relying on

Do i need to mention my name (ILR applicant) in to application form? It seems there is no box for this, - no where to state that

Do i need to submit my original passport/BRP? - yes

If you really want a cover letter search previous posts for what other people used.

No, 3 months wage slips and corresponding bank statements no p60s

For cohabitation, for every 4 months of the last 2 years, one joint letter or one each from at least 3 different sources will suffice.
