FLR (M) or FLR (O) – I am confused

Currently I am Permanent residency which was granted on Jan 2013, I was on Tier 1(general) from March 2007,

I got married before i enter into UK on Tier 1 in Feb2007, My wife got Tier 1 dependant Visa in Mar 2007 and she entered into UK in Sept 2007.
till now she was on Tier 1 Dep visa which is Valid until Oct 2013, I am about to apply her VISA, I am confused which visa to apply FLR(M) or Set(M)

First time applied Dependant Visa from India
Got Tier 1 Dep visa extended in 2011 and before that another extension applied from India( All through 6+Yrs she is having valid visa),

My Wife out of UK days -
1st Visit single trip From 10-May-2008 to 10-July-2009 – 60 days (30 days I was there with my wife in India)
2nd Visit - From 03-Oct-2009 to 30-Oct-2010 – 390 days(150 days I was there with my wife in India)
3rd Visit – From 08-Oct-2011 to 13-Aug-2012 – 300 days (30 days I was there with my wife in India)
4th Visit – From 24-May-2013 to 21-Aug-2012 – days 88 days

We had a Twin babies in 2009(born in UK), then she had surgery in India,

Kindly suggest me with which visa to apply now, Due to apply my wife visa in next 2 months’ time

Set(o) as you qualified for settlement as a PBS applicant and your spouse has been a PBS dep for 2+ years. There was absences, but they were arguably limited.

Your children are entitled to register as British as born in the UK and you are now settled.

there is option for Tier 01 dependants, I assume SET(M) is the right choice, correct me if i am wrong

Why do you keep saying set(m)?

Set(o) form states under section 3 subsection B - PBS dependent. Unless you switched from PBS dep to flr(m) it would not be set(m).

I am planning to apply my spouse ILR some time this month,
I got my ILR in Jan2013 on Tier 01 General

Applying with below documents
1. SET(o) application
2. Photos
3. Passport & Bio metric card (she is in UK from last 6 yrs)
4. Marriage certificate
5. My ILR & Passport
6. Some Utility bills & council tax bills
7. My Last 1 yrs bank statements
8. Life in UK pass certificate

Let me know if i need to include any other documents, English language test related documents needs to be included in this month???

KOL is currently sufficient for settlement.

Although, as Amber mentioned, your wife should be using the SET(O) form, they may require cohabitation evidence, similar to those suggested in SET(M) form.

They may require evidence of subsisting marriage for any periods that you were apart.
