ILR-British Citizen help for my Husband and step son

Post by elizabethsmum » Sat Jul 27, 2013 1:42 pm

Hello My husband and I have been married 12 years this August, I moved to the USA when I was 19 and we got married 6 months later, my husband had a child who was 2 at the time we met (my step son) I have raised my step son as my own since he was 2 (he will be 15 this year) My husband and I have a daughter together who has both a USA and British passport (lucky devil) We moved to the UK in 2007 and my husband and step son have indefinite leave to remain visa's in their US passports. We have decided that we are wanting to go back to the USA next year but I have spoken to a few people that say we should get my step son and husband to get their British citizenship sorted before we leave just in case we ever want to come back ( we have no plans to but I will never say never the UK will always be my home)

My questions are

1. What is the cost to get them citizenship?
2. How long is the process?
3. Can they apply for it at a later date? How soon will their Visa's not be valid anymore once we leave? Is there a way to keep it valid without coming back all the time?
4. Will my step son lose his visa when he turns into an adult because I am not his biological parent?
5. Will my daughter always be able to have 2 passports or once she turns 18/21 will she have to choose?
6. Is there a different process to follow to get my step son his BC because I am not his biological mother? His Mom has agreed to sign anything that she needs to, will she need to fill anything in or can we do it all?

My questions are

1. What is the cost to get them citizenship? See the link below - Form MN1 for your stepson and form AN for your husband
2. How long is the process? currently takes between 4 weeks and 8 weeks to get approval then you have to book a ceremony and after this you can apply for passports. Children are not required to attend a ceremony.
3. Can they apply for it at a later date? How soon will their Visa's not be valid anymore once we leave? There are many queries about this on the forum, but in effect they will lose their ILR after 2 years. I would strongly suggest they apply for Citizenship.
4. Will my step son lose his visa when he turns into an adult because I am not his biological parent? No
5. Will my daughter always be able to have 2 passports or once she turns 18/21 will she have to choose? She will always have dual citizenship, turning 18/21 does not change anything.
6. Is there a different process to follow to get my step son his BC because I am not his biological mother? His Mom has agreed to sign anything that she needs to, will she need to fill anything in or can we do it all? Register him for British Citizenship under section 3(1) on form MN1 - http://www.ukba.homeoffice.gov.uk/briti ... shcitizen/
