Can i sponsor my wife's sister....?...

Post by Daveseli » Mon Jul 29, 2013 11:14 am

Hello there. I was just wondering if i can be a sponsor for my wife's sister. I let you know that I support my wife as well as she is under spouse visa, i am british citizen and i work full time with an income around £30000 per year after tax. My wife is studying and not working right now. My sister in law wants to come to live and work here in the UK as she is a professional seamstress and has been working in her country for more than 8 years. Please help me with an answer or possible a link from UKBA webpage, which application should it be appropriate on this case.

Thank you david

Unless she is dependant on you and has severely bad health - she will have to qualify for a visa in her own right.

In reality this means she'll need to find a tier 2 sponsor in the UK.

Hi, lets clarify myself a bit more, my sister in law wants to come and live in the uk, i want to support here with everything asked by UKBA. So she will be my dependent, she hasn't got any health problems at all. Can i apply for her or my wife has to be?

Thank you for your reply

Your sister in law cannot be sponsored by ANYONE (on a personal basis) to come and live here unless she qualifies for the adult dependant relative visa - for which - the qualifying criteria are:

http://www.ukba.homeoffice.gov.uk/visas ... dependent/
* You need long-term personal care to perform every day tasks, such as washing and cooking.

* The care you need is not available in the country where you are living, either because it is not available and there is no person in the country where you are living who can reasonably provide it or it is not affordable.

* Your sponsor can show that he or she is able to provide adequate maintenance, accommodation and care for you without having to rely on public funds. Your sponsor will need to sign a sponsorship undertaking form to confirm that they will be responsible for your care without relying on public funds for a period of at least 5 years.
Since these rules were brought in (July 2012) - the reported effect is that just one of these visas has been granted.

So you should regard that as a no go.

As I said before - her most practical option is to find a company willing to sponsor her under tier 2.

Her alternative is to come as a student - but she's almost certainly missed the boat in terms of this year's university entrances.
