Post by skhan111 » Wed Jul 31, 2013 12:26 pm

Dear all
I would be grateful for some advice please
I was previously married to someone on student visa
We stayed together a d he got his indefinite
Leave . Now we are divorced I have recently found
When we got married he was still married to
Someone else my question is
1. If I get remarried as my parents are thinking about
It so prob someone from Pakistan. When I apply for his visa
Application what is likely to happen will they interview or likely to be rejected as prev married
2. I have been speaking to advisor may be able to get marriage annulled
If that happens do I have to declare it on
My application .what checks do they do in Dubai on the applicant sponsor etc
3.if the marriage does get annulled does my so called ex lose his leave in uk
I know it's a very sticky situation but I need some sensible and practical advice before I can proceed .thanks

If he was already married (and it was recognised in the UK) then you should apply to have it annulled. Moreover, you could report your ex to the Home Office and it is possible that his ILR would be revoked as he had committed serious deception. It's not often ILR gets revoked but this is the kind of example where it could.

nullity

Post by sublime688 » Wed Jul 31, 2013 9:06 pm

I dont understand. You said that the marriage which you now know was a nullity, was ended by a divorce. Now, even if that marriage was never ended by a divorce it would be considered null and void anyway because it never existed in the eyes of the law in the first place.

So why are you worried that the Home Office will refect your application because of the previous marriage which is ended.

Also, I dont think you need to get the marraige nullified since you already have divorce papers. Except you wish to report your ex for the offence of bigamy, that is entirely up to you. If you report him, what happens to his current leave thereafter would be out of your hands and will be the business of the Home Office. Since you were not a party to the offence, if you choose to report it with evidence that you were innocent, it should not affect your future dealings with the UKBA
