Hi, im asking for some advice regarding my husband applying for spouse visa. I am a british citizen with two children to a previous marriage both are disabled. I believe i am exempt from finacial requirements as i am on dla indefinite low rate care and i am a carer for my daughter also. I am 4 months pregnant. I am confused to what income is needed and savings are needed. I recieve child tax credit, child benefit, carers allowance, income support, housing benefit, and council tax paid. If possible you could advise me as soon as possible, many thanks.

You would be exempt from the new financial requirement. You would need to show you can adequately maintain and accommodate yourselves. Do you have any savings? Does your husband have a job offer and what Country is he from?

Hi I have £4,000 in savings. My husband is from Nigeria and he has S.I.A. security badge no job offer at present.

The savings will help, a job offer for your husband would also be advantageous. What is the breakdown of your income?

Hi thanks for the reply. My husband was here on student visa before, he worked for agencies, he keeps getting job offers through his email which he will print and use in our application. My income on a weekly basis is carers allowance 59.75, child benefit 33.70, child tax credit 255.16, income support 76.25. Monthly I receive 84.00 dla for me, 400.60 dla for my daughter, and 296.00 for my son. Will my children dla be taken into account as my income?

A couple with 2 children would need, £112.55 + (£65.62 x 2) = £243.79 per week income Net after deducting any rent.

Your income is £59.75 + £33.70 + £255.16 + £21.00 + £76.25 = £445.86 per week, I would not include the child’s DLA as that is her/his care and or mobility needs.

You also have savings and a job offers.

Based on that information I would say that you satisfy the ability to adequately maintain yourself. All benefit departments should be made aware that you are living as a couple. Although a recent case was rejected with some similar circumstances, if you list the income clearly and supply evidence of the savings (3 months bank statements) I suspect you would be ok.
