Question about switching course. Please help.

Dear all.

Firstly, apologies if this has been answered, but I have searched and couldn't find anything that fit just right.

So my girlfriend has just completed a foundation course and is starting a 3 year degree programme this year. The plan was for her to renew her visa while she was still in the UK. However, I have just realised that her new course starts more than a month after her current permission ends, which is against the rules according to the UKBA. Her current permission ends on the 18th of August whilst her new course begins on the 30th of September, a gap of about 6 weeks.

I was wondering if anyone has any experience in getting around this situation, either by pleading with the UKBA or otherwise. I am looking for anyone I could contact so as to try and plead her case.

Since you are already aware about the tier 4 guideline. Better to find similar course at different institute which fit in this criteria otherwise based on current plan extension need to apply from outside the UK.

Do you think there is any chance at all that the UKBA will grant any kind of leniency? I am aware they are not known for their compassion, but this rule is going to make things very difficult for this particular situation.

Her foundation course only just sent her certificate out a few days ago, so she was only able to send it onto the new institute as proof in the last few days. We are waiting for them to issue her a CAS number. Assuming that takes a little while she could end up with only a few weeks to make the application, which leads to the worry as to whether it will be complete in time.


Does anyone know what the average waiting time for a Tier 4 in the USA is? Including getting the biometrics date. I have read the UKBA webpage but the processing times do not specify how long it takes to get the biometrics appointment, only times from when they have a complete application.
