My friend has been told she is not British but an overstayer

Post by finegirl » Sun Aug 04, 2013 12:32 pm

Years ago my friend was in the UK seeking assylum, then she abandoned the whole process and assumed the identity of a british citizen, using someone else's british passport. She used the British passport to travel to America to give birth to her baby, after friends advised her to have her baby in America .

After returning to the UK, she continued to use the british identity, claiming benefits and other british entitlements. She then got together with a dutch man (still under her british identity), had a baby with him, consequently she and her children were able to naturalise under EU laws. Her children are now british citizens.

However things caught up with her, she is now serving time for benefit fraud. Immigration have also discovered her false identity and informed her in prison that she is an overstayer, as she entered the country under a different name (her original name), seeking assylum. Please what chances do we have? My friend has nothing back in her country of origin and was desperately fleeing abject poverty, and in the process was trying to maximise her chances of never returning back to that situation in her country, now all this trouble. Please help!

Your friend has committed very serious offences. Not to mention the impact on the family/victim of the person's identity she stole. As the offences may carry a custodial sentence she should seek advice from a solicitor. I think her nationality should be the least of her concerns at the moment.

No she hasn't been told that! She already knew she was not British.

I concur with Amber above, she is in serious trouble and it is essential that she seeks legal advice.

Based upon what you have posted, not only has she committed immigration offences in the UK, she has also done that in the US.
