I have my appointment slated for next week Wednesday @cardiff peo but have some question to solve.i been on spouse visa since sept 2011 and being living together with my British partner,we have two kids both British but my wife was claiming tax credit as single mum for the years ignorant of the rules that says we have to claim jointly.i am self employed get paid by cash from client.my question is as follows
1)do you think the single tax credit claim will have negative impact on us?though we have informed the hmrc about this and they have stopped the single claim and asked to apply as couple which we have done but still expecting the outcome
2)we received a letter from hmrc saying my wife got overpayment due to late declaration of being living with a partner,so do you think this will make our case not straight forward?
3)what should I put on the form where it asks about if we receive tax credit or not?as the tax credit is stopped for now?
4)do you think I can apply without receiving the tax credit notice yet?
5)can I still use peo for my application as I doubt if my case is straight forward?
I will be grateful if you genius can reply to my questions ASAP

Don't worry about the tax credits issue as you've reported the change of circumstances albeit very late and worrying won't help. You'll likely face an overpayment but you can dispute it and ask them to deduct what you would have received as a couple from the overpayment amount, then the rest (if any) to be written off if it'll cause hardship (it not, arrange a repayment programme). I would tick you are not receiving tax credits and put in the extra information box/piece of paper the your tax credits have been suspended due to a change of circumstances and you're awaiting a new award notice, as it'll be on the bank statments and may raise an issue as to why it's not been declared, I wouldn't elaborate further unless questioned, applying at the PEO should be ok.

This is from the UKBA website:
ukba wrote:If you are applying on a paper application form, you will need to pay an appointment fee of £100 per applicant. You must pay this fee before you attend your appointment. To pay this fee, you must call our immigration enquiry bureau between 9:00 and 15:00 on 0870 606 7766. You must call us to pay your fee by the next working day after you book your appointment online. If you do not, your appointment will be cancelled. We therefore strongly advise that you call to pay as soon as possible after booking your appointment.

As a Self-Employed person you are no doubt required to complete Self Assessment tax returns. So have you done the return for the year to 05.04.13? If yes, how much net profit did you disclose in that year?

OK, so you make your business accounts up to 31st December, so the tax return to 05.04.13 would disclose the profits for the year to 31.12.12. Totally OK.
So those annual profits to 31.12.12 still giving you a good idea how much you are making now? Or are you now making more?

So that information gives you a clue how to compete the visa application form?
Now many hours per week do you work in order to make that sort of money?

Given that you're working more than 24 hrs per week and there is a child you may be entitled to Working Tax Credits though, you'll find out once you receive your award notice which you should check carefully for consistency.
How much is your rent? Yes you can include/must your wife's benefits, I assume she was recently working and her JSA is contribution based?

Is the housing benefit and council tax benefit in joint names? Is there a single person/lone parent applicable amount on the breakdown? Generally, JSA will be contribution based for the first 6 months if she pad enough NI after that she may be eligible for income based but your income is likely to reduce it.
By checking for consistency I mean against what you earn etc... That's it's accurate.

Ok as long as you've informed them of your immigration status and they're not giving you a couple applicable amount (£112.55 of the benefit award notice).

i need to chip in this, myself and my partner are both director of a limited company started last year but the company made a lost this last tax year so i decided not to include it in my application or do you think i should let the caseworker be aware about this?

When did you enter the UK on a spouse visa and when does your current visa expire?
