That being the case, you can apply for your ILR any time between now and the expiry date of 29.10.13.

@john,does it what waiting because of tax credits award notice if i can apply now?

If you can make your application a bit later that might be beneficial as your income is tight and your tax credits award would help to show adequate maintenance though, you must bear in mind your wife's JSA is ending/will likely be reduced soon. Basically you've got to show £112.55 Net disposable income per week plus £65.62 per child after deducting any rent costs (non in your case).

As you'll be submitting 3 months bank statements your declared income should tally up with that, so perhaps average the last 3 months earnings. Under the old rules the specified evidence isn't a strict as under the new rules. So long as on the balance if probabilities you can adequately maintain and accommodate yourselves.

This what I wanted to put on the maintenance section my weekly income £150 and income from my wife's benefit £33.70(CB)+£46(JSA) also I will state I have some musical instruments worth £2000 to sell on Ebay.
So £150+£33.70+46=£199.70
Plus my savings £2500 in my bank account

Why is the JSA only £46 per week?

On a separate note, the income support applicable amount (what you should be able to show, disposable income Net per week after rent) for a couple and two children, is, £243.79 per week. Though, the savings can help. Showing you're selling things on eBay is not going to help.

the actual JSA is £56 but they do deduct £10 every week for some overpayment she had sometimes ago.
sorry the total is £150+£33.70+£46=£229
asper the ebay stuff,if i will be able to sell them say tomorrow can i just put the sum into my account and explain its the money from my property sale but without anything to show as proof(maybe my payment statement on ebay can be a proof)?

With that JSA amount, your spouse must be under 25. If the money was paid into your PayPal account you should be able to pay it straight into your bank account and get a certified statement from your branch. Taking that with the eBay invoice should suffice. Your income plus the savings should suffice.
